Licensing Program Analyst (LPA) Andrea Cortez arrived at the facility and was greeted by principal Angie Zarate-Orejel. LPA explained the purpose of the unannounced complaint investigation is to deliver findings pertaining to the above allegations.

During the investigation LPA conducted interviews and document reviews which revealed that two parents were prohibited from entering the facility. One parent was advised by the Licensee they were no longer allowed in the facility, and another parent was suspended for a week. LPA received written correspondence corroborating the allegation and an unusual incident report was provided by the facility. Based on interviews and record review the preponderance of evidence standard has been met. Therefore, the above allegations are SUBSTANTIATED.

Licensing Program Analyst (LPA) Andrea Cortez and met with Regional Director Melanie Fristor (RD), for the purpose of conducting an unannounced complaint investigation to deliver findings pertaining to the above allegations. The purpose of today's inspection was explained.

During the investigation, LPA interviewed parents and reviewed documents related to the allegations. It was alleged that a child was left in soiled clothing for approximately 15 minutes, inappropriate communication with an authorized representative in the child's presence, and an uncleared staff member caring for a child while waiting the parent to arrive. The investigation revealed inconsistent interviews and video footage submitted from the licensee that did not support the allegations as a result the allegations are unsubstantiated due to insufficient evidence. Although the allegation may be true or may have happened, there is not a preponderance of evidence to prove the allegation; therefore, the allegation is unsubstantiated. Exit interview was conducted and report was reviewed with RD. Appeal rights were provided. Notice of site visit was given and must remain posted for 30 days.

Licensee shall provided proof that parents are allowed access to center during the normal operating hours. In the event there is a court order preventing parents’ entry into the facility. A copy of the court order shall be placed in the child's file.
