Licensing Program Analyst (LPA) Jennifer Velasco met with Facility Representative, Maria Elena Marin (Representative) to conduct an unannounced subsequent complaint investigation inspection pertaining to the above allegations. The purpose of today's inspection was explained. During the investigation, LPA observed care, reviewed facility documents, and conducted interviews with children, staff, and parents.

Based on multiple witness statements, facility staff allowed a parent to discipline someone else’s child. Multiple witnesses stated a parent pulled a child out from under a low table, picked up the child, and tried to make the child apologize to another child, causing no injury to the child. Multiple witnesses stated the staff stood by and watched this. Based on multiple corroborating witness statements, staff did not intervene when another child’s parent disciplined a child. The preponderance of evidence standard has been met; therefore, the above allegation is SUBSTANTIATED. Exit interview was conducted and a copy of this report was given to the Facility Representative. Notice of site was given and must remain posted for parental review for 30 days. Appeal rights were provided.

Licensee stated staff have been retrained to ensure behavior management is handled by staff. Licensee has also stated she will review patternsof childrne's behavior to ensure she is proactively safeguarding the safety and well-being of all children in care. POC met.
