**THIS IS AN AMENDED REPORT**
On July 25, 2025, Licensing Program Analyst (LPA) Kyrsten Williams met with director, Huimin (Mindy) Huang, to open a complaint investigation for the above allegation and deliver complaint findings. At approximately 10:30am, Program Officer Lynda De La Mora, arrived at the facility. The purpose of today's inspection was explained. Present today was 10 toddler age children and 3 preschool-age children, being supervised by 8 staff members. Throughout the investigation, LPA made observations, reviewed records and conducted interviews with staff.

It was alleged staff left children outside unsupervised. During interviews, LPA learned there was an incident recently where two children were outside on the playground without supervision. LPA learned the incident occured while the class was transitioning from indoors to outdoors. 7 of 8 staff interviewed corroborated the allegation that children were unattended outside, but it was unclear how long the children were left unsupervised.

During interviews, it was stated the facility typically maintains supervision by utilizing zones that each teacher is assigned to, consistently doing head counts, roll calls, and sweeps of the classroom and playground. During inspection, LPA observed staff members standing in assigned zones indoors and outdoors. LPA also observed staff members doing head counts frequently and positioning themselves so they can supervise the entire classroom. LPA did not observe supervision concerns during the time of inspection. LPA reviewed records of roll call sheets used to keep children accounted for.

Based on the information gathered the department has found that the allegation staff left children outside unsupervised to be SUBSTANTIATED: meaning that the allegation is valid because the preponderance of the evidence standard has been met.

As a result of the substantiated allegation, a Type A citation will be issued on the attached LIC9099-D for violation of CCR 101229(a)(1). Upon receipt, the director shall post and provide copies of this licensing report to parents/guardians of children who are currently enrolled as well as parents/guardians of children newly enrolled at the facility during the next 12 months. Parents/guardians must acknowledge receipt of this report and citation by signing a LIC 9224, “ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS”. A copy of this form should be placed in each child file upon receipt from parent.

Exit interview conducted with director, Huimin Huang, and Program Officer, Linda De La Mora. A copy of this report was provided. The facility representatives were provided a copy of their Appeal Rights (LIC9058) and the facility representatives signature on this form acknowledges receipt of these rights. A notice of site visit was given and must remain posted for 30 days.

Staff will receive training on effective supervision and safety. Faciltiy representative will submit meeting notes and attendance sheet with staff signatures via email by POC due date. Staff will receive mandatory training on 8/7/2025 to review the safety and supervision plan.

Based on interview, the facility did not comply with the section cited above as two children were left unsupervised on the playground, which poses an immediate health, safety, or personal rights risk to persons in care.
