Licensing Program Analyst Katy Velazquez (LPA) conducted a field visit to the facility for the purpose of an unannounced annual inspection. LPA disclosed the purpose of the inspection and was granted entrance into the facility. LPA met with the Director Tazmin Godamunne (D1). LPA toured the facility inside and outside. LPA observed 10 preschool aged children being supervised by D1. LPA accessed Guardian to verify that all required adults were background cleared. LPA observed that hazardous items (disinfectants, cleaning solutions etc.) were inaccessible to children in care. Facility days and hours of operation are Monday-Thursdays from 7:00 AM to 5:30 PM and Fridays from 7:00 AM until 4:00 PM. The facility provides 2 snacks per day and parents provide lunch.

LPA conducted a file review prior to inspection and verified that annual fees were current. While on location, LPA reviewed care and supervision of children, staffing ratios, medications, first aid supplies, furniture, equipment, fire drills, and drinking water. LPA observed all required forms to be posted. There appear to be adequate toys and equipment available for children. LPA toured the outdoor play area and observed wood chips as cushioning.

LPA reviewed the sign in/out documents and observed that the children who were currently in-care were signed in. LPA reviewed children’s and staff files. LPA observed Health Screening Reports with TB test and required MMR and TDAP vaccines for D1. D1 has expired Pediatric CPR and First Aid training. LPA observed current Mandated Reporter training for D1; D1 was reminded to renew the course every 2 years. This training requirement may be met by using the Department’s Office of Child Abuse Prevention (OCAP) online training modules. The OCAP modules are free of cost and available at: http://www.mandatedreporterca.com/. The training is currently provided in English and Spanish.

This facility provides Incidental Medical Services (IMS). LPA did not review storage of “medication and equipment/supplies nor reviewed children’s records because currently, no children's medication is stored at the facility. The Facility DID NOT COMPLETE TESTING PRIOR TO THEIR DEADLINE. Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test. For childcare center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1- CCP). LPA verified that the lead testing was completed in accordance with the Written Directives outlined in PIN 21-21.1-CCP.

D1 was reminded that all adults 18 and over, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

LPA Velazquez informed Director Godamunne that this report dated 09/12/2023 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. LPA informed D1 to provide a copy of this licensing report dated 09/12/2023 to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. LPA Velazquez informed Director Godamunne that this report dated 09/12/2023 documents 1 Type B citation which shall be posted for 30 consecutive days as there is a potential risk to the health, safety, or personal rights of children in care. An exit interview was conducted, and the report was reviewed with D1. LPA provided Licensee Appeal Rights to D1. A Notice of Site visit was posted by LPA and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Based on LPA observation the licensee did not comply with the section cited above when licensee operated a childcare center while supervising 10 children alone. The children have not always been within the licensee's line of sight and the children have been accessing the entire facilty and not within proximity to licensee. The lack of supervision poses an immediate health, safety or personal rights risk to persons in care.

Licensee will purchase baby-gates to barricade the classroom to one area and email LPA photos of the installed gates by 5pm on 09/13/2023. Licensee will hire a Teacher to offer Licensee breaks and email LPA the name and schedule of the breaking teacher by 5pm on 09/13/2023. Licensee will barricade the doors and closets in the bathroom making them inaccessible to the children in care. Licensee will create a bathroom schedule to take the children to the bathroom all at once to provide supervision. Licensee will email the schedule to LPA by 5pm on 09/13/2023.
