32 | Regarding allegations of staff entering room and being inappropriate the facility staff interviewed denied any knowledge of incident's like that taking place. Staff interviewed state resident can be confused when awoken and regularly requests a PRN in the evenings for pain. facility administrator requested specific dates to review facility camera footage in hallways but alleged victim was unable to identify any specific dates regarding the allegation. LPA could not obtain any evidence of staff entering a resident's room and acting inappropriately. LPA interviewed resident's on either side of the alleged victim and no resident identified any strange noises or disturbances in the the evenings or overnight. LPA attempted to gather additional information from the reporting party but the reporter was anonymous with no contact information.
Although the allegation may have happened or is valid, there is not a preponderance of the evidence to prove that the alleged violation occurred. The Department has determined that the allegations of personal rights are unsubstantiated but if any additional information is received this complaint can be amended and the finding can be changed.
There are no deficiencies noted or cited per California Code Regulation, TITLE 22.
Exit interview was conducted with the facility administrator. Appeal Rights were issued, and a copy of this report was left at the facility. |
