32 | 9099C-1... Ombudsman notes she used the distance measurement app on her cell phone to check the distance between the outside curb area from Old Auburn Road to the resident gate areas. Based on the distances determined, it's unlikely that anyone who was on Old Auburn Road could hear yelling or noise from inside any of the resident gate areas, considering the traffic levels on Old Auburn Road. Additionally, RCC stated she and the Ombudsman went outside and were unable to hear any noise.
Staff stated also in an interview that given the triple digits for heat temperatures over the weekend of July 29/30, 2023, it's unlikely anyone would have their window down also, and when she has parked on the street she is unable to hear any conversations from the community due to the noise of the traffic on Old Auburn Road. RCC and staff interviewed indicated there are no blond caregivers currently working during any shifts, including the weekends. RCC confirmed she was not at the facility on the said weekend. LPA has conducted several recent inspections at the community and has never observed staff to yell at any residents.
Based on information obtained during the investigation, LPA finds this allegation to be UNFOUNDED-meaning that the allegation was false, could not have happened and/or is without reasonable basis.
Allegation: Staff failed to treat resident with dignity and respect. Complaint alleges the same staff was upset and yelled at a resident, "if I have to come out here on my day off again you will get yours.".
Ombudsman's notes from the 8/4/23 inspection indicate that she met and spoke with several residents who indicated they are happy and comfortable with the care at the facility. Additionally, several residents who were near the front entrance area that day, appeared "healthy, dressed and groomed appropriately". Another resident who had previously fallen and sustained a bruise indicated she was doing well, was able to walk without any assistive device and "her facial injuries were healing". LPA has conducted several recent inspections at the community and has always observed staff to treat residents with dignity and respect.
