This is an amended document provided to the facility to more accurately reflect the deficiency cited during the inspection on 10/4/21.

On 10/4/21 at 11:00am Licensing Program Analyst (LPA) Kevin Gould conducted an unannounced Case Management inspection to gather more information regarding the home being listed for sale.

LPA met with the administrator and together called the owner of the facility. LPA explained the purpose for the inspection and the concerns from the department regarding the home being listed for sale. LPA confirmed that the home is listed for sale and the owner is "testing the water" for a potential sale as the current owners are looking to retire. Owner states that they are in the preliminary stages and would like to ensure the home continues to be used as a residential care facility for the elderly and would like to minimize disruptions to their residents if they wanted to continue to live in the home with potential new owners.

Owner confirmed that the facility has not notified residents at this time as they are no where near the required 60 days notice time and did not want to panic the residents or their authorized representatives prematurely. Administrator apologized if they should have notified licensing prior to listing the home but they could not find any regulations requiring notice at this time to residents or licensing.

Based of the information obtained during today's inspection, the following deficiencies are cited per California Code of Regulations, TITLE 22.

Exit interview was conducted with the Administrator. Appeal Rights were issued, and a copy of this report was left at the home.

Sale of licensed facility; resulting issuance of new license; procedure Notwithstanding Section 1569.19, in the event of a sale of a licensed facility where the sale will result in a new license being issued, the sale and transfer of property and business shall be subject to both of the following:

The licensee shall provide written notice to the department and to each resident or his or her legal representative of the licensee's intent to sell the facility at least 30 days prior to the transfer of the property or business, or at the time that a bona fide offer is made, whichever period is longer. This requirement was not met as evidenced by conversations with Licensee and administrator and confirmation that no notification has been made to residents in care of intent to sell which poses a potential health and safety or personal right risk to residents in care.

This requirement was not met as evidence by photos from the home sale web site did reveal some resident confidential information such as their name. LPM observe confidential information of a resident "Helen" which poses a potential heath, safety or personal rights risk for residents in care.
