25 | On July 27, 2023, at 2:01 p.m., Licensing Program Analyst (LPA) Kendal Zirbes conducted an unannounced case management deficiency inspection and met with facility representative Kecia Loving. LPA disclosed the purpose of the inspection and was granted entry into the facility. 88 preschool children, seven teachers and additional staff were present in the facility during this inspection.
On July 26, 2023, the Department was informed of an incident that occurred at the Center in February 2023. The incident was regarding a potential personal rights violation that involved child 1 (C1) and staff 1 (S1). According to the information received, parent 1 (P1) informed the management team that while reviewing the live streaming option on the Sprout About App, P1 observed S1 grab C1 by the wrists and force C1 to sit at the table. After P1 made the management team aware of the incident S1 was placed on administrative leave while the management team conducted an internal investigation. Staff interviews reported they were unsure if this incident was reported to the Department. LPAs review of the facility file showed zero evidence that the Center reported this incident to the Department. This incident was unusual and threatened the physical, and emotional health or safety of C1, therefore the incident was required to be reported to the Department. The facility failed to meet the reporting requirements. A deficiency is being cited based on the LPA record review and interviews in accordance with the California Code of Regulations, Title 22, see LIC809D.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
An exit interview was conducted, and the report was reviewed with facility representative Kecia Loving.
