Interviews confirmed staff were aware of C1's allergies and verbally reminded C1 to not eat the food item. Confidential child interviews confirmed C1 ingested food C1 was allergic to. A doctor's note dated 12/1/22 was reviewed. The doctor's note listed the food items which C1 should not be fed. Facility records documented C1 was offered these food items on 7/17/23, 6/8/23, 5/11/23, 4/26/23, 3/29/23.
Regarding the allegation involving S1 yelling at the children in care. Confidential interviews confirmed S1 yells at the children in care. Interviewees described S1 interactions as “screams”, “yelling”, “loud”. Interviewees expressed S1s interactions made them feel “sad” and “upset”. S1 confirmed a raised voice is utilized in the classroom as a way of grabbing the children's attention.
Based on confidential interviews and record review, the above allegations are valid because the preponderance of the evidence has been met, therefore, the above allegations are found to be substantiated. California Code of Regulations, Title 22, Division 12, Chapter 1, regulation 101223 (a)(2) Personal Rights and 101223 (a) (1) are being cited on the attached LIC 9099D.
LPA Kendal Zirbes informed facility representative Kecia Loving that this report dated July 27, 2023 documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.
Also, LPA Kendal Zirbes informed the facility representative to provide a copy of this licensing report dated July 27, 2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. An exit interview was conducted, and the report was reviewed with facility representative Kecia Loving.
