On January 9, 2023 Licensing Program Analyst (LPA) Zirbes conducted a complaint inspection to SBCUSD-Bradley Preschool to deliver the findings for the above complaint allegations. LPA disclosed the purpose of the inspection and was granted entry by facility representative Emily Aguilar. LPA observed 12 children being cared for by one teacher and two aides. The investigation consisted of interviews with staff, children, parents, and a review of documents.
The Department received an allegation alleging staff 1 (S1) yelled at the children in care. S1 denied yelling at the children and denied other staff members have yelled at the children in care. S1 confirmed using a loud voice when speaking with the children and confirmed that due to the dynamics of the classroom the atmosphere is louder. According to the information received S1 utilized a “firm”, “raised” and “stern” voice with the children in care, describing S1’s interactions with the children as “screaming” and “yelling” daily in children’s faces.

The Department received a second allegation alleging that S1 shamed multiple children in the classroom. S1 denied the allegation, stating inappropriate behavior of a child is acknowledged and then the classroom moves on. According to the information received, a child was shamed when the other children in the classroom pointed out the mistake the child had made under the direction of S1. All interviewed witnesses confirmed children were being shamed in S1’s classroom when S1 would have the whole class tell the child their behavior was wrong. Over the course of the investigation, CCL learned that Child 1 (C1) and Child 2 (C2) were left in soiled clothing after having potty accidents at school under the direction of S1. The investigation revealed C1 was ill the morning of the incident and the facility choose to accept C1 into care with notification from the parent of the child’s illness.

Based on the information obtained, the above allegations are deemed Substantiated. A finding of substantiated means that preponderance of the evidence to prove that the allegations are valid. The facility has been cited Type B citations for Personal Rights violations. Please see LIC 9099D.



An exit interview was conducted, and a copy of this report was read and provided to the facility representative Emily Aguilar on this date, along with a copy of the appeal rights, Notice of Site visit was given and must remain posted for 30 days.

On January 9, 2023, Licensing Program Analyst (LPA) Zirbes conducted a complaint inspection to SBCUSD-Bradley Preschool to deliver the finding for the above complaint allegation. LPA met with facility representative Emily Aguilar.
The Department received information that staff 1 (S1) has a whiteboard posted in the classroom which lists the names of children who are not allowed to utilize certain play areas of the classroom due to inappropriate behavior. The information received further stated that children were not allowed water if certain behaviors are exhibited. S1 denied that any child is denied water. S1 and witnesses stated if “no water” was written on the whiteboard this meant the child could not utilize the water table. According to S1, an area may be closed for the safety of the children, or if the children exhibit behavior such as failing to clean up the area. S1 stated if an area is closed, the reason why is discussed with the children. Child interviews did not report inappropriate discipline.

Based on the information obtained during interviews and the documentation reviewed, it is determined that S1 may or may not have inappropriately disciplined children. Therefore, the allegation is unsubstantiated at this time. Although the allegation may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violation occurred.
