32 | While touring the outdoor play space, LPA obtained photographs of the following: LPA observed the padded play surface to have multiple patches of missing/degraded material, as well as visible cracks. The padded surface was observed to have a sandy texture and loose material on the surface due to the degraded areas. LPA observed exposed tree roots in the accessible grassy area near the back fence, which protrude out of the ground above the grass. Additionally, LPA observed a section of black top pavement near the playground’s entrance with an exposed crack and uneven surface leading to a concrete walkway which surrounds the padded play surface. LPA observed the blacktop pavement’s crack and uneven surface to span the length of 48 inches, with a section of its surface protruding 2 to 3 inches higher than the adjacent concrete walkway.
Interviews conducted with Facility Staff disclosed that children do fall on occasion while utilizing the outdoor play space. When a child is observed to fall, a “accident/incident” report will be completed as documentation, a phone call will be placed to the child’s representative to explain the incident, and a signature from the child’s representative will then be obtained on the report when the child is picked up from the facility. At time of this visit, LPA reviewed a sample of twelve “accident/incident” reports spanning between the dates of 12/05/2025 to 01/27/2026. LPA observed all the reports to indicate a child had fallen.
Based on LPA's observations, interviews conducted, and records reviewed/obtained, the preponderance of evidence standard has been met, therefore the above listed allegation, Outdoor play space not free of tripping hazards, is found to be SUBSTANTIATED. Please see attached LIC9099D for Type B deficiency cited.
An exit interview was conducted, A copy of this report and appeal rights were given to Site Supervisor, Deborah Johnson during this inspection on 02/24/2026.
LPA issued a Notice of Site Visit and verified it was posted in a prominent location at the facility. Site Supervisor understands that the Notice of Site Visit must remain posted for the next 30 days |
