On the above date and time Licensing Program Analyst (LPA) Susan Brewer arrived at the facility for the purpose of continuing a complaint investigation for the above allegation and to deliver findings. The LPA was greeted and granted entry into the facility by Janelle Valez. The LPA toured the facility and took a census of 36 children supervised by 4 staff. At approximately 9:30 AM the Director Charmaine Foree arrived to join the investigation.

On 07/22/2026 LPA S. Brewer met with J. Valez and C. Foree to initiate the investigation into a personal rights allegation. The LPA made observations, reviewed facility records and conducted interviews with pertinent parties relevant to the investigation. However, more time was needed to complete the investigation.

It was alleged that a staff yells at children in care. Evidence gathered through records reviewed and interviews with pertinent parties reveal that a subject staff admitted to yelling at daycare children, on an unspecified date. It was also revealed that the subject staff later apologized for their actions when addressed by the agency. The staff is no longer employed at the facility.

The LPA conducted additional interviews with pertinent parties and no immediate risks to persons in care were identified as a result of the incident. Therefore, the LPA determined there was an isolated incident of yelling which was a potential risk to persons in care.

Based on LPA’s observations and interviews which were conducted and record reviews, the preponderance of evidence standard has been met, therefore the above allegation that a staff yelled at daycare children is found to be SUBSTANTIATED. California Code of Regulations, Title 22, divisions 101223(a)(3) Personal Rights are being cited on the attached LIC 9099D.

A deficiency for a Type B violation was issued on today’s date.

No civil penalty was issued on today’s date.

An exit interview was conducted, the report was reviewed with Director Charmaine Foree.

A notice of site visit was given and must remain posted on or immediately adjacent to the interior side of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

It was alleged that a staff threw a toy at child in care on an undisclosed date. Interviews conducted by the LPA with pertinent parties stated they observed an incident of subject staff throwing a toy at a child, however the party provided conflicting details in their statements. Additional interviews conducted by the LPA with pertinent parties did not corroborate the allegation that staff throw toys at children. The LPA did not observe any violations during the investigative tour of the facility.

Follow-up interviews conducted with agency representatives indicate the agency was made aware of an alleged incident of a subject staff throwing a toy at a subject child. However, no supporting evidence was obtained during an internal investigation. Other pertinent parties relevant to the investigation were unavailable for the LPA to interview. Therefore, based on conflicting information gathered through interviews, record review and observation, the allegation was determined to be UNSUBSTANTIATED.

Although the allegation that a staff threw a toy at child in care may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

No deficiency was issued for this allegation.

No civil penalty was issued for this allegation.

Based on LPA observations, record review, interviews, and by the licensees own admission, evidence indicates a subject staff yelled at the preschool while supervising children, which is a potential risk to the health and safety of persons in care.
