On 11/27/23 at 9:35 a.m. Licensing Program Analysts (LPAs) Blanca Ruiz and Raymond Moorehead arrived at the facility to discuss and deliver findings of the investigation into the above allegation. A complaint inspection was initiated by LPA Ruiz on 11/02/2023. LPA met with Assistant Director, Ann-Marie Schoben to provide complaint findings related to the above allegation. During today’s inspection, the facility was toured, and census was taken. The facility serves children ages 2 years old to kinder in Preschool and Discovery Preschool Classroom. This is a combination center and other programs are infant and school age. The following was alleged:
It was reported that Staff do not ensure toxic chemicals are safely secure from children in care.
LPA investigated the above allegation and gathered the following information: On or about 10/2023, It was alleged by pertinent parties that staff at the facility neglects children safety by leaving chemicals in unlocked cabinets. Physical inspections of classrooms were conducted on 11/02/23 and 11/27/23 to verify physical environment to in compliance as per Title 22, including classroom equipment inside and outside.

The following information was noted: cabinets in lower and top shelves had broken latches that need to be replace and in good repair to ensure the safety of children. Cleaning supplies were found to be in the lower shelf of the upper cabinet unlocked as teacher arrived and left their purses on shelf upon arrival to the classroom. Children were taken to play outside during the transition. Interviews revealed that teacher(s) holds the key and have it available in an inaccessible compartment known to staff and lower classroom cabinets hold regular classroom supplies. However, during today’s inspection, assistance was requested from Staff N.1 to lock the lower shelf of the upper cabinet to be remain in substantial compliance.
Based on interviews conducted, facility documentation, LPAs observations and additional pertinent information obtained, the preponderance of evidence standard has been met, therefore the above allegation is found to be Substantiated.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Staff N.1 locked all the cabinets during this inspections. Assistant Directors agress to purchase additional latches. Work order and/or pictures of purchase and replacement on the cabinets must be submitted to CCL by deadline.

The facility serves children ages 2 years old to kinder in Preschool and Discovery Preschool Classroom. This is a combination center, and other programs are preschool and school age.
The following was alleged: It was reported that Staff handle children in a rough manner and Staff does not ensure children are spoken to in an appropriate manner. LPA investigated the above allegation and gathered the following information:
On or about 10/2023, It was alleged by pertinent parties there was an incident where staff at the facility was redirecting children to clean up toys up then children were going around the classroom and some hide behind items/furniture.

Staff then approached some of the children in question by picking them up from the top of their arms. Children cried when they were carried to a different place of the room. It was reported that staff told children to stop crying. During inspections conducted on 11/02/23 and 11/27/23, LPAs conducted observation to verify teacher to child ratio, care, supervision, and Personal Rights to assess compliance as per Title 22, Division 12, Chapter 1 regulation. In addition, on 11/27/23 a random group of children were interviewed to obtain information pertaining to the above allegations. Due to the age of the children and developmental states, children’s responses were unclear and conflictive with above allegations. Facility staff denied the allegations. Based on limited information obtained during the investigation, there is conflicting information regarding the allegations. Although allegations may have happened or are valid, there is no preponderance of evidence to prove the alleged violations did or did not occur, therefore allegations are deemed Unsubstantiated at this time.
