On 04/26/2023, at time listed above, Licensing Program Analyst (LPA) Justin Giese made an unannounced visit to the facility for the purpose of concluding a complaint investigation. Allegations of this complaint were received on 03/09/2023. LPA was granted entry to the facility and met with Facility Director, Chanel Sams.

The following was alleged: Facility staff withheld a meal from child in care and Facility staff did not treat day care child with dignity.

It was alleged, on an undisclosed date, a child was observed through the facility’s surveillance cameras via the facility’s “Sprout About App” to be sitting alone at a table and not served a meal.

On 03/16/2023, LPA made an unannounced visit to the facility for the purpose of initiating this complaint investigation. LPA met with Facility Assistant Director, collected/reviewed documents, and interviewed staff associated with the supervision of the child related to this complaint.

Assistant Director and staff involved stated the child in question was not seated alone and was sitting with another child. Staff was serving the children in attendance a meal and ran out of serving bowls and utensils. Assistant Director stated they addressed this concern and brought more supplies to the classroom. Staff stated all the children in attendance were served a meal.

As part of this investigation, LPA collected a written statement from Facility’s District Manager. It was disclosed the management team had reviewed the video footage of the incident, and confirmed the child was not seated alone, nor were they not given a meal. It was disclosed the alleged incident was investigated internally and findings were shared with the authorized representative of the child. LPA was informed due to the length of time the alleged incident occurred; the video footage was no longer available to review.

LPA made direct observations of the classroom where the alleged incident had occurred and noted the classroom is equipped with two small tables, each capable of accommodating six children. The tables are oriented lengthwise with a bookcase between. LPA reviewed live surveillance camera footage for this classroom at time of visit, there are three available camera angles. Only one camera has both tables in view, the other two views only show one table along with other views of activity areas of the classroom. It was undetermined which camera angle was available for view during this alleged incident, or if the location and orientation of tables, are exactly as they were observed during this inspection.

There was conflicting information received during the investigation from what was alleged. This agency has investigated the complaint alleging facility staff withheld a meal from child in care and facility staff did not treat day care child with dignity. Although the allegations may have happened, or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

A NOTICE OF SITE VISIT WAS GIVEN. DIRECTOR WAS INSTRUCTED TO POSTED IT IN A PROMINENT LOCATION AT THE FACILITY. THE DIRECTOR UNDERSTANDS THAT IT MUST REMAIN POSTED FOR THE NEXT 30 DAYS.


An exit interview was conducted, A copy of this report and appeal rights were given to the Director during this inspection on 04/26/2023.
