Due to required lead testing requirements, Licensing Program Analyst (LPA), Susan Brewer conducted a Case Management inspection based on lead testing results received on the facility. LPA S.Brewer toured the facility, took census and met with Licensee Assistant Director Monique, to further discuss lead results received and measures taken for remediation of lead exceedances. Director Johanna Cortes, arrived at approximately 9:10 AM and joined the tour of the facility.

During the inspection, LPA toured and obtained photos of the following water outlets identified in the kitchen as 2 sink-faucets, used by the kitchen staff to prepare food. During an interview with the directors and staff, it was stated and confirmed that tap water is obtained from the 2 kitchen sink faucets to prepare food for all child care program components operated at the facility. The agency does order bottled water, which is used for partial drinking and consumption in only 1 program component to prepare formula as necessary and for staff to obtain water for consumption.


After further review of the analytical reports dated 09/12/2022, 12/06/2022 and 12/20/2022, there were no water samples listed in the sample checklist provided by the A-Tech Consulting, Inc., where water samples were obtained for lead testing levels of 5.5 ppb or lower, on the 2 kitchen sink faucets identified as outlets which are used daily for drinking and consumption at the facility. LPA observed and obtained photos of the kitchen sink faucets identified and reviewed the facility Lead Water Assessment-Analysis reports referenced with the Director Johanna Cortes and Assistant Director Monique Abeyta, for the Tutor Time Learning Center. The licensee was unable to provide proof of lead testing conducted for the 364813345 Tutor Time Child Care Learning Center’s kitchen sinks-faucets. Therefore, during today’s inspection and record review it was revealed that the facility did not meet compliance with this standard as described in the written directives outlined in PIN 21-21-CCP. It was determined that the agency failed to have a total of 2 kitchen sink faucets tested for safe lead levels of 5.5 ppb or below, where staff currently use the faucets as water sources for the School Age classrooms.

101700.6 Grant Funding for Qualifying Child care Centers

(a) Senate Bill 862, Chapter 449, Statutes of 2018 allocated $5 Million to the State Water Resources Control Board for testing and remediation of lead in the drinking water of Child Care Centers based on the following criteria:


(1) Those that serve children zero to five years of age, with the highest priority for Child Care Centers that provide care for children zero to three years of age.
(2) Those that have 50 percent or more of their registered children who receive subsidized care.
(3) Those that operate only one facility.
(b) To determine a Child Care Center’s eligibility for possible funding the Department will provide access to a link to an online eligibility form located on the Department’s website and on Sacramento State’s Office of Water Programs website.
(1) A Child Care Center interested in financial assistance shall complete the eligibility form, which shall include instructions for completing and returning it, prior to receiving any grant funding for which it may qualify. To determine a Child Care Center’s eligibility for possible funding, the provider will need to complete an online eligibility form available at Office of Water Programs’ website

Due to the agency not taking action to test the primary outlets used as a source of water for drinking and consumption for all child care programs operated and as required in the Health and Safety Code Section 1597.16(a)(1), where all licensed Child Care Centers (CCCs) constructed before January 1, 2010 to test their drinking water for lead contamination between January 1, 2020 and January 1, 2023, a deficiency has been cited. See LIC809D Type B for Health & Safety Code Section 1597.16(a)(1).



An exit interview was conducted, and appeal rights discussed. LPA S. Brewer provided Director Johanna Cortes, with a copy of this report, appeal rights and notice of site visit.

This report must be made available to the public upon request for three years.
