The licensee Jocelyn Roces-Lopez, stated the assistant took the children to for a walk to get mail. LPAs looked across the street where the mailbox was located and did not observe the assistant or children. The assistant and children were absent for approximately 30 minutes before returning. Interviews conducted with pertinent parties, revealed the licensee Jocelyn Roces-Lopez, and their assistant, were shuffling children around the property, from room to room, to hide children from licensing. It was also revealed during interviews conducted that daycare children were told to hush and be quiet and while LPAs were conducting the census of children in care as well as touring the facility.
Based on LPA Susan Brewer’s and Laura Mejorado's observations, interviews which were conducted, and a review of records, the preponderance of evidence standard has been met, therefore the above allegation that the licensee Jocelyn Roces-Lopez, is operating out of ratio and/or over capacity is found to be SUNSTANTIATED. California Code of Regulations, Title 22, 102416.5(f) Staffing Ratio and Capacity, is being cited on the attached LIC9099D, Type A violation.
LPAs Susan Brewer and Laura Mejorado, informed licensee Jocelyn Roces-Lopez, that this report dated 07/11/2023 documents a Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
Also, LPAs Susan Brewer and Laura Mejorado, informed the licensee Jocelyn Roces-Lopez, to provide a copy of this licensing report dated 07/11/2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
An exit interview was conducted to deliver the findings of this investigation and a copy of this report and Notice of Site Visit were provided to the licensee Jocelyn Roces-Lopez.
The notice of site visit must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days. |
