On date and time listed the Licensing Program Analysts (LPAs) Susan Brewer and Laura Mejorado, arrived unannounced for the purpose of initiating a complaint investigation into the above allegation. LPAs were greeted by Licensee, Jocelyn Roces-Lopez. LPAs requested entry and waited outside, while the Licensee, Jocelyn Roces-Lopez, stated they were securing their two barking dogs. The licensee returned after 5 minutes and granted the LPAs entry into the facility. LPAs discussed the above allegation: The facility operates out of ratio and/or overcapacity. A census of was taken, there were 15 children present, being supervised by the licensee and 1 assistant. Also present were 2 adult residents.

During today's visit, LPAs made observations, conducted interviews with pertinent parties and reviewed records and gathered information relevant to the investigation. Upon entering the facility, LPAs observed 2 daycare children walking down the staircase from the 2nd floor off-limit areas, 1 daycare child in the front dining room, 1 infant child sleeping in a play pen, 1 infant child was being held by the assistant, 4 children eating in the dining room area and 5 children were playing in the facility’s back den area. ***CONTINUED ON LIC9099C PAGE 2*** THIS IS AN AMENDED REPORT ***

The Licensee, Jocelyn Roces-Lopez, led LPAs Susan Brewer and Laura Mejorado, on a tour of the entire home, both inside and outside. At 10:42 AM, LPAs observed a separate, detached dwelling located in the north-west, rear backyard area of the home which is occupied by tenants and another room attached to the garage, which is used as a 2nd rented space for an individual tenant. Licensee, Jocelyn Roces-Lopez, stated a relative was living in the separate detached dwelling and a friend was temporarily renting the attached room, that is entered from the garage or west end of the home. LPAs requested to tour the detached dwelling and upon entry, were introduced to an adult male resident and observed a minor child standing behind the front door. The licensee stated that the subject child observed was a child friend visiting her relative’s children, who reside in the detached dwelling with their parents. Per Licensee, Jocelyn Roces-Lopez, the child was not enrolled in daycare and the licensee did not have a file for the subject child. LPAs did not observe the other minor resident child(ren) present in the detached dwelling, to support the statement provided by the licensee, that the subject child observed, was visiting her relative’s children for the purposes of play. LPAs inquired on the whereabouts of the other minor resident children, mentioned by the licensee. Information obtained during today’s investigation revealed the relative’s wife took their children out of town, to visit friends and did not know why the subject child arrived at the detached dwelling or why the child stayed, but thought it was “rude” to ask them to leave.

The Licensee, Jocelyn Roces-Lopez, later changed their initial statement to the LPAs Susan Brewer and Laura Mejorado, and stated the subject child observed in the separate detached dwelling, arrived as a drop-in only, due to being a friend and peer of other enrolled daycare children present. Interviews were conducted with pertinent parties, information gathered during the investigation, revealed that the subject child observed in the separate dwelling is a current enrolled daycare child, who was instructed to hide in the separate off-limit dwelling, when licensing arrived to conduct the investigation. Therefore, it was determined that the Licensee, Jocelyn Roces-Lopez exceeded the limitations of the licensed capacity, evidence confirmed the licensee is operating with 15 children in care at the facility. The licensee retracted their statement and provided a copy of the subject child's file to the LPAs, for review.

LPAs returned to the main home and observed 8 of the children and the assistant missing from the census and the assistant gone from the home. LPAs inquired on the whereabouts of the assistant and 8 children.

The licensee Jocelyn Roces-Lopez, stated the assistant took the children to for a walk to get mail. LPAs looked across the street where the mailbox was located and did not observe the assistant or children. The assistant and children were absent for approximately 30 minutes before returning. Interviews conducted with pertinent parties, revealed the licensee Jocelyn Roces-Lopez, and their assistant, were shuffling children around the property, from room to room, to hide children from licensing. It was also revealed during interviews conducted that daycare children were told to hush and be quiet and while LPAs were conducting the census of children in care as well as touring the facility.

Based on LPA Susan Brewer’s and Laura Mejorado's observations, interviews which were conducted, and a review of records, the preponderance of evidence standard has been met, therefore the above allegation that the licensee Jocelyn Roces-Lopez, is operating out of ratio and/or over capacity is found to be SUNSTANTIATED. California Code of Regulations, Title 22, 102416.5(f) Staffing Ratio and Capacity, is being cited on the attached LIC9099D, Type A violation.

LPAs Susan Brewer and Laura Mejorado, informed licensee Jocelyn Roces-Lopez, that this report dated 07/11/2023 documents a Type A citation, which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.

Also, LPAs Susan Brewer and Laura Mejorado, informed the licensee Jocelyn Roces-Lopez, to provide a copy of this licensing report dated 07/11/2023 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

An exit interview was conducted to deliver the findings of this investigation and a copy of this report and Notice of Site Visit were provided to the licensee Jocelyn Roces-Lopez.



The notice of site visit must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

Based on LPAs observations, interviews & records gathered, during today's investigation, the licensee was operating beyond the terms of their licensed capacity with a census of 15 children in care, which is an immediate risk to the health and safety of children in care.
