32 | LPA investigated the above allegation and gathered the following information:
On 09/11/23 and 09/29/23, LPA observed care and supervision activities at the center; interviews with children and staff were also conducted at the facility. Records were reviewed and obtained pertaining to the above allegation. A random group of daycare children were interviewed and reported being aware of the fence being in disrepair and being redirected by teachers to other activities away from the fence. Children also expressed feeling safe and cared for by their teachers. During the process of this investigation the fence was fixed. Lastly, on 10/04/23 an annual inspection was conducted as part of Community Care Licensing (CCL) facility review to address any concerns and to correct any deficiencies cited for the center to be in substantial compliance with Title 22 and Health and Safety code.
During the investigation no additional witness corroborated the observations, therefore, based on the information obtained during investigation, there is conflicting information regarding the allegation. Although allegations may have happened or are valid, there is no preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore allegations are deemed Unsubstantiated at this time.
Exit interview conducted and report was reviewed with facility Assistant Director, Maria Rico . A Notice of Site Visit was given and must remain posted on, or immediately adjacent to the interior of the main door for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
