Licensing Program Analyst (LPA) Rachel Zeron conducted an unannounced visit to the facility for the purpose of delivering findings of this complaint that was initiated on 08/31/2021. LPA met with Director, Anna Cruz, per the Director there were 16 children in care, LPA toured the facility and discussed the purpose of the visit.

During the investigation, LPA Zeron reviewed facility documentation, conducted interviews with relevant individuals pertinent to this investigation. It was alleged that staff handles children in a rough manner, staff inappropriately disciplined day care children, and staff spoke inappropriately to children in care. According to the complaint, staff would grab children by the arms and yanks their arms when they run (to stop them from running) and tells them to “shut up” and “you need to get over it” when the child cries. During circle time staff uses laminated paper shapes to teach the children their shapes (circle, square etc.) and when they don’t pay attention, staff hits them with the laminated paper shapes on their arms, shoulders or heads and shouts “pay attention to me”. During interviews, it was disclosed that for discipline, staff uses verbal redirection. staff is firm and voice is loud but staff is not yelling. Interviewed revealed that staff was never witnessed handling or disciplining children in a rough manner.

It was also alleged, that staff do not properly supervise children in care. According to the complaint, staff looking at their phones and not watching the children during naps, unless they heard a noise then they would look up from their phones. Interviews revealed that staff are not to use their phones while in the classroom. Staff interviewed denies using their cell phone during nap time or witnessing other staff using their cell phone during nap time. Multiple staff disclosed that they use nap time to take lunches and catch up on paperwork.

It was also alleged, that passageways are not kept free of obstruction. According to the complaint, staff block the doors with cots to keep a particular boy who is a “runner” from escaping. Interviews revealed that staff have a written plan of action for Child #1(C1), in which staff is using redirection techniques for C1. Retractable baby gates are being used as part of the plan to keep C1 safe. This gate has been placed on the door that leads to the outside, where the playground is located. This does not pose a danger to children in care, the gate can be easily retracted as witnessed by LPA. There are also two alternate exits in case of an emergency.

The evidence gathered during the investigation reveals conflicting information. Staff denies allegations and other staff cannot corroborate the allegations. Although, the allegations may have happened or is valid, there is no preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are deemed unsubstantiated at this time.

Exit interview was conducted with Director, Ana Cruz. Notice of Site Visit was issued and must be posted for 30 day. A copy of this report was provided to the facility.

A copy of this report must be made available to the public for 3 years upon request.
