25 | On March 11, 2025, at 02:45 p.m., Licensing Program Analyst (LPA) Zirbes met with Licensee Jessica Flores. The purpose of the inspection was to conduct a Plan of correction inspection to ensure the citations issued on February 25, 2025 were corrected. LPA disclosed the purpose of the inspection to the Licensee. When LPA arrived to the facility, the Licensee was providing supervision to two children.
LPA completed a tour of the outside area at 2:50pm. LPA observed the following:
1. The wrought iron gate has a key lockable device that is placed no lower than 60 inches.
2. The Licensee has purchased a Pool Patrol Alarm. LPA observed documentation that the Pool alarm meets ASTM F2208.
3. Documentation the mesh fence meets ASTM F2286.
4. LPA observed one section of an approximately 4 foot wrought iron fence placed on a slanted dirt hill. When LPA measured the height of the wrought iron fence on the slope, the fence measured between 58 inches and 59 inches, which does not meet the required height requirement of 60 inches.
LPA and Licensee discussed the gate height. Per Licensee, over the past few days the area has experienced rain. Therefore, the weather may have pushed dirt under the fence, therefore decreasing the height of the fence. LPA and Licensee discussed that the fence height must always measure 60 inches in height regardless of weather. Licensee will develop a plan to ensure the fence meets the required height. The plan will be submitted to the Department by March 17, 2025.
Since the gate does not meet the height requirements, the Licensee will ensure the children do not play outside until the body of water meets AB 2866.
A notice of site visit was given and must remain posted for 30 days.
