On date and time listed, Licensing Program Analysts (LPAs) Taityana Benson, Raymond Moorehead and Licensing Program Manager (LPM) Aaron Ross arrived at the facility to conduct a required/annual inspection as part of a compliance review. LPAs and LPM toured the facility, inside and out, records were reviewed, and the following was observed and/or discussed:

Normal days and hours of operation are: Licensee operates 24 hours per day, break 6:00 p.m. – 9:00 p.m.
OFF-LIMIT AREAS INCLUDE: All Bedrooms, Kitchen, Laundry Room, Restroom Adjacent to Laundry Room, Enclosed Outdoor Patio, and Garage
The facility is operating within the licensed capacity and appropriate ratios
· Appropriate supervision provided during this inspection
· A working telephone is present and current number on file
· Appropriate fire extinguisher, smoke detector and carbon monoxide detector present and were tested by the Licensee during this inspection.
· Fireplace is properly screened to prevent access by children (Plywood)
· All hazardous items are stored inaccessible to children
· Toxins are locked
· Weapons are present/stored according to Licensee. Licensee understands all guns, weapons and ammunition must be key locked separately and made inaccessible per Title 22 Regulations

· Verification of control of property on file (Lease Agreement)

Operation of A Family Child Care Home
(g) The home shall be free from defects or conditions which might endanger a child. Safety precautions shall include but not limited to: (5) All licensees shall ensure the inaccessibility of pools (in-ground and above-ground), fixed-in-place wading pools, hot tubs, spas, fish ponds and similar bodies of water through a pool cover or by surrounding the pool with a fence. (A)Fences shall be at least five feet high and shall be constructed so that the fence does not obscure the pool from view. The bottom and sides of the fence shall comply with Division 1, Appendix Chapter 4 of the 1994 Uniform Building Code. In addition to meeting all of the aforementioned requirements for fences, gates shall swing away from the pool, self-close and have a self-latching device located no more than six inches from the top of the gate. Pool covers shall be strong enough to completely support the weight of an adult and shall be placed on the pool and locked while the pool is not in use.

Licensee agrees to submit a written statement ensuring the department that the backyard is off limits, the wooden gate will remain locked and that 100% visual supervision will be provide when children are playing in the front yard. The Licensee also agrees to notify LPA Benson by 10/25/23 once all necessary corrections have been made to comply with Title 22 regulations regarding to bodies of water. This citation will result in a civil penalty in the amount of $500.00.

Failure to correct the cited deficiency(ies), on or before the Plan of Correction (POC) due date, may result in a civil penalty assessment.

· Upon entering the backyard LPA observed the wrought iron gate propped open by a large rock. The 5-foot wrought iron gate is not self-latching and self-closing. LPA observed two windows located in the off limit of the home that provide direct access to the pool. LPA observed an additional gate located on the east side of the home that allows access to the pool. LPA observed an inoperable pool cover during the visit. Licensee stated the pool cover is not used because their dogs damaged it on multiple occasions.

· The Licensee can submit transfer forms to associate new individuals or to disassociate someone from your facility at: Associations_Disassociations862@dss.ca.gov
- LPA discussed the safe sleep regulations with Licensee, Cynthia Guzman and discussed the Child Care Licensing Safe Sleep webpage at: https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource.
- LPA also informed Licensee, Cynthia Guzman of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at: https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Also, LPA Taityana Benson informed the Licensee, Cynthia Guzman to provide a copy of this licensing report dated 10/18/2023 that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
