25 | On 9/26/24 at 10:20 am, Licensing Program Analyst (LPA) Patricia Berry conducted a Case Management (CM) visit to conclude an investigation of an Unusual Incident Report (UIR), which was received on 09/10/24. The UIR stated a child was inappropriately handled by two staff members. On 09/11/24, LPA conducted a CM, where LPA conducted interviews, reviewed video footage, and obtained photos. During today’s visit, LPA met with Deserie Martinez, toured the facility, and took census.
During the investigation of the UIR, LPA viewed video footage. LPA observed two teachers handling a crying child in an inappropriate manner. In the video, staff were observed grabbing the child’s arms inappropriately, roughly removing the child from the classroom doorway, and holding the child under the child’s arms.
Staff did not admit to handling the child inappropriately; however,staff stated they know they could have handled the situation differently.
LPA received five photos of the child’s injuries. The photos show multiple red marks, abrasions, on the child’s neck, back, leg and side of their body.
The facility after becoming aware of the situation immediately notified the parents of the injured child, contacted Community Care Licensing by telephone and sent in the Unusual Incident report. The Facility contacted Law Enforcement and sent an email to each parent/authorized representative in the facility regarding the incident. Training was conducted with all lead teachers on personal rights, discussing proper touching and if frustrated what to do to help yourself and the children. Training's are conducted on a regular basis on personal rights. Training's have also been previously done 7/24 with Community Care Licensing.
