32 | It was alleged that on or about the first week or second week of October 2022, Children’s Personal Rights were violated at the facility. It was disclosed during the investigation process that Child #1 reported to parent (s)/ legal guardian(s) Staff #1 hit Child #1 on the back because he/she did not want to get up from a nap. LPA Ruiz obtained information and video footage of the time and date of incident located in classroom. After conducting interviews with pertinent parties, LPA Ruiz was able to gather enough information that corroborates staff and child were both in the same room when the alleged incident occurred; however,
Staff #1 denies hitting the child and video footage showed staff assisting the child to get to the restroom but no sign of intent to hurt was shown in the video footage. During the video, child is not showing any signs of distress nor pain entering or leaving the restroom.
Director acknowledged knowing about the alleged incident. An internal investigation was conducted and an in person meeting with parent (s)/legal guardian(s) of Child #1, Staff #1 and all other parties involved took place to clarify the incident; and to come to a resolution by assessing child’s well-being, as well as to acknowledge child’s Personal Rights.
After a thorough review of all information obtained, facility was unable to determine if the alleged incident took place since video footage does not capture all angles of the area where the incident was observed and/or reported by child(ren), and/or capture by the classroom' camera. Moreover, a delay occurred addressing the issue to clarify the incident and child was not available for interview.
Based on the information obtained during the course of the investigation, there is conflicting information regarding the allegation. Although allegations may have happened or are valid, there is no preponderance of evidence to prove the alleged violation(s) did or did not occur, therefore allegations are deemed Unsubstantiated at this time.
An exit interview was conducted with Director, Pauline Copas, appeal rights discussed. Licensees understands that the Notice of Site Visit must remain posted for the next 30 days.
A copy of this report was provided to the licensee and this report must be made available to the public for 3 years. |
