On March 20, 2024, Licensing Program Analyst (LPA) Taityana Benson arrived at the Ruelas Family Child Care Home to conclude the investigation regarding the above allegation, a previous inspection was conducted on March 05, 2024. LPA met with Licensee, Veronica Ruelas and conducted a tour of the facility inside and outside. During the investigation, interviews were conducted with pertinent parties and documentation was collected.

On February 26, 2024, a complaint was received alleging a child in care sustained unexplained bruises on both of their inner arms, between their shoulder and elbow due to a lack of supervision at the facility. The child attended the facility during the operating hours on the day the bruises were observed by their parent. It should also be noted, the parent of the daycare child discovered bruises on both of their arms later that evening and not at pick up.

The parent of the daycare child did not seek medical treatment for the bruises on the child’s arms. It was disclosed that the licensee and their assistant provide supervision to daycare children in care and did not observe any bruises on the subject child on their last day in care nor leading up to their last day in care at the facility. It was disclosed that on more than one occasion during the daycare child’s enrollment, their clothing covered the area where the bruises were discovered. Therefore, the licensee did not observe bruises on the daycare child arms upon drop off or throughout the day. The licensee and the assistant are aware of supervision requirements and stated they do not leave daycare children unattended. Therefore, department is not able to determine if the child sustained injuries while in care at the facility or elsewhere. Lastly, the investigation did not reveal if the bruises on the daycare child arms were a result of lack of supervision while in care at the facility.

Although the allegation regarding Lack of Supervision may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

No deficiencies cited at this time.

A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
