25 | On December 5, 2024, Licensing Program Analyst (LPA) Zirbes conducted an unannounced case management inspection to Neverland Child Care Center. LPA met with Licensee Chelsea Vinson. Upon arrival, LPA observed 11 preschool children and nine toddlers in care. Staff members on site included, three teachers, one aide and the Administrator/Licensee.
During a walk through of the Center, LPA observed staff 1 (S1) in the kitchen preparing meals. LPA reviewed the staff associations for the Center and observed S1 was not listed as having obtained an eligible California clearance. Per Administrator, S1 has worked at the Center since October 2023. According to the Administrator, S1 primary role is preparing meals and covering teacher breaks. Per Administrator, S1 works approximately 30 hours a week at the Center. LPA and Administrator discussed S1 background clearance. Administrator expressed S1 had an eligible clearance which allowed the Administrator to associate S1 to the Center in November 2024. Administrator expressed the Center did not received paperwork notifying the Center that S1 did not have an eligible clearance. LPA completed a reviewed of the Departments background clearance system at approximately 12:55pm. The Department records revealed S1's background is in process. During the inspection, the Administrator did not provide LPA with documentation showing S1 had a eligible California background clearance.
Based on record review, interviews, and observation, S1 is an employee who has been working at the Center since October 2023. S1 did not received a California clearance prior to working at the Center. A type A citation was issued for regulation, 101170 (e) (1) Criminal Record Clearance, as this poses a immediate risk to the children in care. Refer to LIC 809D. Furthermore, an immediate assessment of a civil penalty of one hundred dollars ($100) per day for a maximum of five days has been issued as S1 was working at the Center since October 2023.
