On 6/25/2024, Licensing Program Analyst (LPA) Carol Heath met with the Director, Teresa Langdo, and the licensee, Annette Romero, to conduct an unannounced Annual/Random inspection for the infant program. LPA disclosed the purpose of the inspection and was granted entry to the facility. The infant center consists of 1 room. During today’s inspection, LPA observed 1 infant and 1 teacher in the Infant room. The hours of operation are 6:00 am -6:30 pm, Monday - Friday. The center also has a Pre-School and School-age component. Incidental Medical Services (IMS) were discussed. No IMS for the infant program.
Physical Plant: Furniture and equipment were inspected for age appropriateness and good repair (highchairs and feeding tables have broad-based legs, highchair trays lock, highchairs are washable, changing table padding thickness in regulation and are within arm's length, seating table and chairs are age appropriate). There are no walkers on the premises. Potty training will be done for this age group upon parent request (toilet training begins at age 2). The bedding is changed daily (washed). The bedding is stored separately and properly inside the cubbies. Floor mats and cots (stored in a locked area) were observed. Used diapers are put in a trash container with a lid underneath the changing table. Each child will have (already in Infant #1 room) a container labeled (photo and name) with personal items. The infant room is clean and safe. There is a bathroom with one toilet. There is a sink (age-appropriate) near the changing area for children.

The sanitation solution is inaccessible to infants (under the sink with a lock). Age-appropriate cribs, cots, changing tables, and feeding chairs were clean and in good repair. The staff bathroom is located in the Toddler room. LPA observed sinks within arm’s reach of changing tables, soap, and paper towels available. Cots are available for napping. The director states they are sanitized daily (bleach & water), and linens are washed and changed daily. They are stored separately within separate cubbies. The Center uses an electronic system to log daily infant activity. *The sign-in and out process is used to procure the app.
LPA observed 4 cribs and 4 cots; the director states that 6 are used as evacuation cribs. Both rooms’ disinfectants, cleaning solutions, poisons, and other dangerous items were inaccessible to children and stored in cabinets with safety latch.
The licensee maintains the temperature in rooms that children occupy between a minimum of 68 degrees F (20 degrees C) and a maximum of 85 degrees F (30 degrees C).
LPA observed the first-aid supplies in a location accessible to staff but inaccessible to children. LPA advised the director that the following supplies must be in each first aid backpack: (1) A current edition of a first-aid manual. (2) Sterile first-aid dressings. (3) Bandages or roller bandages. (4) Adhesive tape. (5) Scissors. (6) Tweezers. (7) Thermometer. (8) Antiseptic solution.
The outdoor: The infant outdoor activity space is physically separate from the space preschool and school-age children use. The outdoor play equipment was inspected for health, safety, good repair, and age appropriateness. All equipment is securely anchored to the ground. There is a grass and concrete area for active play. The area was observed to be free of debris. There is an area for shade and rest. Drinking water is available. The play area was inspected for hazards and inaccessibility to bodies of water. The outside area is completely fenced. No bodies of water are on the premises, and they are completely gated.

Care and Supervision: The center was found to be operating within its specified ratio and capacity. LPA observed children and contained emergency contact information. The sleeping log was reviewed. The staff followed Safe Sleep Regulation to conduct 10-15-minute checks. LPA shared LIC 9227 with the director and Licensee. All infants should have an Individual Infant Sleeping Plan (LIC 9227) in their file.
Staff Records/ Children Records: Children's and staff records were reviewed. LPA verified that at least one staff member is present with current CPR and First Aid Training (expiration 09/28/2024). All staff complete the Mandated Reporter training every two years. All staff receive the Measles, Pertussis, and Influenza vaccinations. All staff have required fingerprinting associated with the facility.
LPA reviewed 2 children's records, which were incomplete and missing forms. LPA observed Infant Sleeping logs in the infant room, but no LIC 9227
Food Service: Menus were observed and posted weekly. Allergy lists with pictures of corresponding children were reviewed and found posted on the door in the Infant room and the kitchen cabinets. Food and snacks were reviewed for availability, quantity, proper storage, and appropriateness to children in care. Food preparation areas were toured for safety, cleanliness, and proper equipment (2 refrigerators/freezers w/ temperature logs, sink, microwave, and stove/oven). Food is kept separate from cleaning supplies. There was 1 additional refrigerator/freezer inside of the infant classroom. LPA observed bottles labeled with the infant's names and current date. Soaps, detergents, cleaning compounds, or similar substances shall be stored in areas separate from food supplies.

Other:

·Telephone service, heating, lighting, and ventilation were evaluated.


· The isolation area for sick children is located in the front office.

· A review of medication policy indicated that prescription medication is administered only with the parent's permission. The Director and other administration staff administer medication and document the dosage, date, and time on a log. Medication is brought and taken home by the parent daily. Medication is appropriately labeled and stored in its original container.

The incidental Medical Services (IMS) policy was discussed. For IMS information, see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to the publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www.ada.gov/childqanda.htm. The Center does not provide IMS at this time.

§1596.8662 - As of January 1, 2018, childcare providers, administrators, or employees who work in a licensed facility shall complete the mandated reporter training provided according to paragraphs (2) and (3) of subdivision (a), and shall complete renewal mandated reporter training every two years following the date on which he or she completed the initial mandated reporter training. Staff was informed that they needed to take mandated reporter training.

§1596.7995 (a)(1) Commencing September 1, 2016, a person shall not be employed or volunteer at a daycare center if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year.

All Licensing reports are available for review online and are considered public information. Summary: Assembly Bill 2621 added Section 1596.819 to the Health and Safety Code, to require the Department to post certain licensing information for CCCs and FCCHs on its public internet website.
Fingerprint clearances and transfers: Before working or volunteering in a licensed childcare facility, all individuals subject to a criminal record review shall obtain a clearance or criminal record exemption. If a fingerprint clearance has been obtained through the Department, Licensee may request a transfer of a criminal record clearance from one state-licensed facility to another using form LIC 9184
Each report (documenting a Type A citation) shall remain posted for 30 days along with the Notice of Site Visit (printed out during this inspection). In addition; all parents of currently enrolled children and any newly enrolled child for the following 12 months shall receive a copy of the report documenting a Type A Citation and sign form LIC 9224 acknowledging receipt. Staff is aware of the required forms for children's files and forms that shall be posted after licensure.

Senate Bill AB 633 - Child Care Facilities: Parent Notification Requirements


Summary: This bill amends Health and Safety Code (HSC) sections 1596.859, 1596.8595, 1596.8895, and 1597.05 to improve the transparency of licensing records and to ensure that parents/guardians using a licensed childcare facility are aware of situations that present the greatest danger to children.
The Parent Board contained all documents required to be posted according to Title 22 Regulations. Staff is certified in Pediatric CPR and First Aid. A fully stocked first aid kit is available, and a fully charged fire extinguisher and carbon monoxide detectors are in place. The fire drill/earthquake log has been posted.
