32 | It was then that staff, including the licensee, realized the child was missing from the facility.
A staff member confirmed solely transporting and supervising approximately ten children. The staff member also noted returning with approximately 10 children, but is unable to notate when the child wandered off. The licensee stated during the investigation, the staff member reported returning with only nine children, despite having knowledge of ten children being counted at departure for the park. The licensee confirmed they continued their transition to the next part of the schedule, which was lunch. Furthermore, the licensee confirmed not being aware the child was gone until law enforcement arrived at the facility.
Based on all the information obtained from pertinent parties, documentation, records review during inspection, the department has determined the preponderance of evidence standard has been met, therefore the above allegations are found to be SUBSTANTIATED.
