On November 29, 2023, Licensing Program Analyst (LPA) Zirbes conducted a follow-up complaint inspection to Ready Set Grow Learning Services. LPA met with facility representative Zaray Ochoa. The purpose of the inspection was to deliver the finding for the above complaint allegation. The investigation included an inspection of the facility, a review of facility records, and confidential interviews with staff and parents.

On October 12, 2023, the Department received an allegation alleging the center is not feeding child 1 (C1) as directed by the family. Confidential interviews provided inconsistent information, as some interviewees reported concerns while other interviewees did not report concerns regarding the food service. A review of the Infant/toddler daily reports and the infant needs and service plan was completed. Per C1’s feeding plan dated August 4, 2023, C1 was to eat 8oz every 1.5 hours. The September 25, 2023, infant and toddler daily report documented a conversation between Staff 1 (S1) and Parent 1 (P1). Per documentation, C1 was to be provided with 8oz of formula every two hours. C1’s infant and toddler daily reports for September 26, September 28, and September 29, 2023, documented C1 was being fed every three hours by the staff.

Based on a review of the records, the preponderance of evidence standard has been met. Therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations Title 22, Division 12, Chapter 1, regulation 101427 (c) Infant Care Food Service is being cited on the attached LIC 9099D.
Notice of Site Visit was given and must remain posted for 30 days. An exit interview was conducted, and the report was reviewed with facility representative Zaray Ochoa.

Per facility representative, the Center will continue to communicate with the parents and update the feeding plan as necessary. A staff training will be completed. A copy of the staff training sign in sheet will be provided to the Department.

Based on record review, C1s individual feeding plan indicated C1 was to be fed every two hours. Per documentation, C1 was being fed every three hours, which is not in accordance with C1 individual plan. This poses a potential Health, Safety or Personal Rights risk to the persons in care.

On November 29, 2023, Licensing Program Analyst (LPA) Zirbes conducted a follow-up complaint inspection to Ready Set Grow Learning Services. LPA met with facility representative Zaray Ochoa. The purpose of the inspection was to deliver the findings for the above complaint allegations. The investigation included inspections of the facility, a review of facility records, and confidential interviews with staff and parents.

On October 12, 2023, the Department received two allegations. One allegation alleged child 1 (C1) was not being changed as often as necessary as C1 was coming home with extra soiled clothing and C1 was observed to be in a soiled diaper on multiple occasions. Confidential interviews reported conflicting information as some interviewees reported zero concerns with the infants diapering and others reported concerns. The staff reported infants’ diapers are changed as required and the diaper changes are recorded on the infant/toddler daily reports. LPA reviewed the infant/toddler daily reports for C1. Per reports, C1s diaper changes were occurring ever two hours or more often if needed. Report continued on page two

The second allegation alleged that on an unknown date in September 2023, one teacher was supervising eight infants/toddlers. This allegation also alleged that the infants are left alone on blankets on the floors without teacher interaction. Confidential interviews revealed inconsistency. Interviewees reported there are staffing issues and had concerns regarding the teacher/infant interactions, other interviewees reported no staffing concerns and expressed the teachers have been observed playing and caring for the infants. LPA completed an unannounced inspection on October 19, 2023. LPA observed three staff members caring for nine infant/toddlers. Staff were observed feeding and sitting on the ground with the infants/toddlers. Over the course of the investigation attendance records were reviewed for September 2023 and October 2023.

Based on the information obtained there is not enough evidence regarding the allegations alleging staff left infants in a soiled diaper for a long period of time and the facility is operating out of ratio. Therefore, the allegations are deemed UNSUBSTANTIATED at this time. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.
