On August 23, 2023, at 10:00 a.m. Licensing Program Analyst (LPA) Kendal Zirbes met with Facility Representative Rebecca Magana and Zaray Ochoa. The purpose of the inspection was to conduct a required one year inspection at the licensed facility. LPA disclosed the purpose of the inspection to the Facility. Present during today’s inspection were 12 infant age children, one teacher, three teacher aides and additional staff members.
When LPA arrived on the premises at 8:50 a.m. there were a total of 10 infants in care. During the inspection LPA walked in and out of the infant room. At approximately 1:06pm, LPA observed 12 infants in the infant classroom. Per the infant license issued by the Department, the Center is licensed to provide care to a total of 11 infants (birth to 2 years of age). Based on LPA observation, review of attendance records and roster, the Center was providing care to 12 infants between the ages of birth to two years of age. Therefore the Center was operating beyond the conditions and limitations of the license. A Type A citation was issued as this is an immediate risk to the persons in care. Refer to LIC 809D.

The infant/toddler area consists of one classroom and a outdoor activity area. The classroom has an area for the infants, a separate area for the toddlers, a infant sleep area and an area for food preparation and diaper changing. The Center shares a kitchen, staff restrooms, staff break room and administrative office with the other licensed components. The center operates an School Age Program (#364844265) and Preschool Program (#364844266). The center operates 6:30am-6:00pm, Monday through Friday.

Indoor/Children's Area: Infant/toddler center is equipped with appropriate furniture and equipment. Furniture and toys were maintained in good repair, safe condition and was age appropriate. LPA did not observe sharp points or edges, or small parts that could be swallowed. During the tour of the classroom, LPA observed the corner climber in the toddler play space had approximately five rips in vinyl material in various areas. LPA advised the Center that the equipment was showing signs of wear and advised the Center to monitor the equipment to ensure it is in good condition. Report Continued on page two

There are hand washing sinks within arms length of the changing tables. No infant is left without supervision nor left unattended. LPA observed trash cans for solid waste have tight fitting lids. All materials and surfaces are toxic free. No fireplaces were present. There are carbon monoxide detector, smoke detector and Fire Extinguishers located throughout the Center. The Center had working telephone service on the premises. There is an isolation room for children who become ill while in care. The facility maintains a comfortable temperature at all times. Water is available inside the classrooms (sippy cups, bottles). Used diapers are put in a air tight container. Each infant/toddler has a container labeled with their name for the storage of personal items. No smoking is allowed on the premises. LPA did not observe baby walkers or other prohibited play equipment on the premises.
During the tour LPA observed five infants laying on their backs on the floor. A staff member was sitting on the floor with the infants. LPA observed one tummy time mat in the play space on the floor which one infant was laying on. Facility representative showed LPA an additional mobile/tummy mat that the Center has for the infants. LPA and facility representative discussed the benefits of visual and auditory stimulation for the infants. LPA discussed the benefits of tummy time mats, tummy time mirror toys, rattle socks, plush materials or sensory toys for the infants to enjoy while they are on the floor. Based on LPA observation the Center does not appear to have a proper amount of materials to encourage and provide auditory, visual, tactile and manipulative stimulation for the infants under one year of age. A type B citation was issued, refer to LIC 809D. Furthermore, during LPAs tour of the classroom at 12:06p.m. LPA observed child 1 (C1) asleep in a crib with a pacifier in their mouth. The pacifier was attached to the child's clothing. This is an immediate risk to the child therefore a type A citation was issued, refer to LIC 809D.

Napping: LPA observed mats and cribs. LPA observed three of five crib mattress were covered in a polyester material which is not vinyl or a similar moisture-resistant material. A Type B citation was issued, refer to LIC 809D. LPA observed five cribs in the infant sleeping area. During LPAs, inspection the Center had six children under the age of one who are unable to climb out of a crib. Infants under one are not on a sleep schedule therefore the center must have six crib available for the infants. Another crib was brought out of storage during this inspection. A Type B citation was issued. Refer to LIC 809D. Evacuation crib was available.

Other: Electrical outlets are inaccessible, there are no recalled and or prohibited toys or sleep/play equipment observed on the premises. Window cords were inaccessible to children.

Restrooms: The classroom has one diaper changing area. According to the facility representative all children are in diapers and are not being potty trained. The Center has a staff bathroom.


Outdoor: Outdoor play equipment was inspected for health, safety, good repair and age appropriateness.
LPA observed the infant outdoor space had one portable climber in the space. LPA did not observe additional items in the outdoor area for the infants to enjoy. LPA observed the padded mats that cover the cement were scattered around the space and overturned. LPA observed approximately ten sharp rocks and a piece of cement with chain link fence attached in the infant play space. Facility representative stated the public gained access to the space over the weekend and ripped up the pads. Per facility representative, the staff have not had time to organize the outdoor play space yet. Per facility representative due to the tropical storm earlier this week and the hot summer weather the infants have not played in the outdoor space. A technical advisory notice was provided to the facility.
Posting Requirements: Center has required posting posted (license, PUB 393, car seat law information).
Due to time constraints LPA was unable to complete the entire annual inspection. LPA will return to the Center on a future date to complete a review of the staff and child files.

Based on LPAs observations on this day, two type A citations, three type B citations and advisory notices were issued.

LPA Zirbes informed facility representative Zarary Ochoa that this report dated 8/23/23 documents two Type A citations which shall be posted for 30 consecutive days as there are immediate risks to the health, safety, or personal rights of children in care.

Also, LPA Zirbes informed the facility representative Zarary Ochoa to provide a copy of this licensing report dated 8/23/23 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the facility representative Zaray Ochoa.
