25 | On August 24, 2023 at 10:20 a.m., Licensing Program Analyst (LPA) Kendal Zirbes conducted an unannounced Plan of Correction (POC) inspection and met with facility representative Zaray Ochoa. LPA disclosed the purpose of the inspection and was granted entry into the facility by the Facility Representative. 12 infants were present with one teacher, three teacher aides and additional administrative staff members.
During this inspection, LPA and facility representative Zaray Ochoa completed a tour of the facility at approximately 10:40 a.m. LPA observed the following:
1. At 10:55 a.m. LPA received a copy of the attendance paperwork from the infant classroom, LPA conducted a count of the infants in care and observed a total of 11 infants (C1, C2, C3, C4, C5, C6, C7, C8, C9, C10, C11). LPA then reviewed the sign in sheets completed by the parents and observed that C12 was signed into the Center at 10:00 a.m. LPA discussed the information with the facility representative Zaray Ochoa. Zaray Ocha explained that C12 an 18 month old child was moved into a preschool classroom to introduce C12 to the environment. LPA reviewed the Preschool License and the Infant Center License limitations and capacity. The preschool license allows the Center to care for children ages 2 - 5 years of age. The Infant license allows the Center to care for children ages 0 - 24 months.
Based on LPA observation, record review and interviews conducted with facility representative, the Center had a total of 12 infants, which violated the capacity of the infant license. On 8/23/2023 the Center was cited for regulation, 101161(a) Limitations on Capacity. The plan of correction was due 8/24/23. Due to the facility failing to correct the deficiency by 8/24/2023, a civil penalty was issued for failure to correct. Refer to LIC 421FC.
A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Facility Representative Zarary Ochoa. |
