On October 12, 2022, Licensing Program Analyst (LPA) Zirbes conducted a follow-up complaint inspection to Ready Set Grow Learning Services. LPA met with facility representative Norma Torres and Zaray Ochoa. The purpose of the inspection was to deliver the findings for the above complaint allegations. Over the course of investigating the allegations regarding personal rights and reporting requirements, LPA conducted confidential interviews with staff, parents and children. In addition, LPA completed a review of the facility records. Confidential interviews revealed staff made comments to the children regarding their ears not working. These comments made the children feel as though something was wrong with their ears. Staff interviews confirmed the staff have made statements such as “are your ears working", " it does not seem like your ears are working” , or "your ears are not working". Based on confidential interviews, there is a preponderance of evidence to prove that staff made inappropriate comments in the presence of day care child which violated the child’s personal rights. Therefore, the above allegation is substantiated, and a type B citation was cited.

A second allegation was received alleging the staff did not notify day care children's authorized representatives of a COVID positive staff in July 2022. Staff interviews and facility records confirmed two staff members tested positive on July 24, 2022, and July 26, 2022. Furthermore, all confidential parent interviews reported they were not notified of the COVID positive staff. When LPA reviewed the facility records the facility was unable to provide documentation verifying the authorized representatives were notified. Based on confidential interviews and record review, there is a preponderance of evidence to prove that staff did not notify day care children's authorized representatives of a COVID positive staff which is a violation of the reporting requirements. Therefore, the above allegation is substantiated, and a type B citation was cited.

A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with facility representative Norma Torres and Zaray Ochoa.

Per Facility Representtive a training on personal rights and how to speak to children occurred on October 11, 2022 with all staff. Facility will submit sign in sheets to the Department and Agenda by October 17, 2022.

On October 12, 2022, Licensing Program Analyst (LPA) Zirbes conducted a follow-up complaint inspection to Ready Set Grow Learning Services. LPA met with facility representative Norma Torres and Zaray Ochoa. The purpose of the inspection was to deliver the findings for the above complaint allegations. Over the course of investigating the allegations regarding personal rights, LPA conducted confidential interviews with staff, parents and children. In addition, LPA completed a review of the facility records. Confidential interviews with parents and children revealed inconsistencies regarding if Staff 1 (S1) pushed Child 1 (C1) or if unknown staff member(s) yell at the children in care. Staff interviews denied the allegations. Staff reported they have guided children by placing their hand on the back of the child however denied a child was pushed. Furthermore, staff interviews denied children at the day care are yelled at. Staff reported the staff have loud voices however denied the violation of personal rights. Facility records did not provide evidence that the personal rights of the children were violated. Based on inconsistencies, the allegations are deemed Unsubstantiated at this time. A finding of unsubstantiated means that the allegation may have happened or is valid, but there is not a preponderance of the evidence to prove that the alleged violation occurred.
