25 | On November 29, 2023, Licensing Program Analyst (LPA) Kendal Zirbes conducted an unannounced case management deficiency inspection and met with facility representative Zaray Ochoa. LPA disclosed the purpose of the inspection and was granted entry into the facility. 36 preschool children, four teachers, three aides and additional staff were present in the facility during this inspection.
The Department received information that child 1 (C1) was involved in seven biting incidents between August 31, 2023, and October 12, 2023. Per interviews and facility records, C1 bite other children in the classroom on five different occasions between September 22, 2023, and October 12, 2023, which caused injuries to the other children involved. Per facility records and interviews, the authorized representatives were informed of the incidents. Facility records revealed C1 was suspended from the Center for a total of four days because of the biting incidents. LPA completed a review of the facility file, which revealed zero evidence that the Center reported this unusual incident to the Department. The accumulation of biting incidents and the suspension of C1 was unusual and threatened the physical, and emotional health or safety of C1 and the other enrolled children, therefore the incident was required to be reported to the Department. The facility failed to meet the reporting requirements.
Based on the interviews conducted and a review of the records, a citation was issued on the attached LIC 809D for California Code of Regulations, Title 22, Division 12, Chapter 1, regulation 101212 (d)(1)(C).
Notice of Site Visit was given and must remain posted for 30 days. An exit interview was conducted, and the report was reviewed with facility representative Zaray Ochoa. |
