On July 9, 2024 at 09:10 a.m., Licensing Program Analyst (LPA) Kendal Zirbes conducted an unannounced Plan of Correction (POC) inspection and met with facility representative Zaray Ochoa. LPA disclosed the purpose of the inspection and was granted entry into the facility by the facility representative. 36 preschool age children, three teachers, two aides and one administrative staff member was present.
At 9:20 am. LPA completed a tour of the facility with the facility representative Zaray Ochoa. LPA and facility representative observed the following: At 9:24 a.m., LPA observed the neck portion of a broken glass bottle along with three other pieces of broken glass in the preschool outdoor activity space. In addition, five piece of paint chips longer than one inch in length were on the sand surrounding one vertical wooden painted pole for the sand box cover. LPA observed preschool age children playing in the outdoor activity space. The broken glass was located to the back of the outdoor activity space. A barrier was not present which prevented the children from accessing the above items which are not age appropriate and pose a hazard to the children in care. During the inspection, facility representative removed the items from the outdoor activity space. LPA was provided todays outside checklist. The checklist identified an unknown staff member completed a check of the outdoor area and did not observe hazards. Per facility representative, staff 1 (S1) completed todays inspection. On 6.24.24, LPA received an email from facility representative Zaray Ochoa. The email contained evidence that a staff training occurred on 6.24.24. The staff training was regarding a morning walk-through of the outdoor space prior to the Center opening. A checklist was provided to the staff. Therefore the failure to correct citation and the $1200.00 civil penalty were issued in error. See below for correct deficiency regarding violating a safe outdoor activity space.
Based on LPA observation and record review a type B citation was issued for regulation, 101238.2 (d)(2) Outdoor Activity Space, refer to LIC 809D. The Center was previously cited for regulation 101238.2 (d)(2) on June 20, 2024, therefore this is a repeat violation and civil penalties were issued for the observations on July 9, 2024. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted appeal rights and report was reviewed with the Facility Representative Zaray Ochoa. |
