S2 confirmed S2 walks with children to the front office when a child needs a moment outside of the classroom. S2 confirmed child 3 (C3) has dropped to the ground while walking to the front office. S2 denied, C3 or any other child was injured while walking to the front office. S2 denied S2 has handled a child in a rough manner. Regarding S2 threatening the day care children. S2 confirmed S2 communicates with the child about their behavior however S2 denied any child was threatened with not being able to return to school. LPA completed an unannounced inspection on August 26, 2024. During this inspection LPA observed S2 interact with the children in care. LPA did not observe S2 violate a child’s personal rights on August 26, 2024.
The Department received a third allegation alleging staff 1 (S1) has yelled at the day care children on multiple unknown dates. Specifically on August 13, 2024, around lunch time, S1 could be heard yelling at the children from the parking lot of the Center. Staff interviews denied hearing S1 yell at the day care children and described S1 as soft spoken, mellow, reserved, and quiet. Confidential interviews with parents and children were unable to corroborate the allegation regarding staff yelling at day care children. S1 denied yelling at the day care children. S1 expressed S1 raises their voice to grab the attention of children or to keep a child from being harmed. LPA completed an unannounced inspection on August 26, 2024. During this inspection LPA observed S1 interact with the children in care. LPA did not observe S1 violate a child’s personal rights on August 26, 2024. Facility records indicated there was an incident on August 13, 2024. Per records, the staff were speaking in louder voices due to the loudness of the lunchroom at this time.
Based on the information obtained from LPA observation, and the confidential interviews there is not enough evidence regarding the allegations alleging staff handled day care child in a rough manner, staff threatened day care child, and staff yelled at day care children. Therefore, the allegations are deemed UNSUBSTANTIATED at this time. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are UNSUBSTANTIATED.
Notice of Site Visit was given and must remain posted for 30 days. An exit interview was conducted with facility representative Zaray Ochoa. Appeal rights and a copy of the report were provided to facility representative Zaray Ochoa. |
