On May 22, 2023, Licensing Program Analyst (LPA) Zirbes met with the Facility Representative Zaray Ochoa for the purpose of conducting an unannounced required one year inspection. LPA toured and inspected the facility in accordance with the facility sketch. There were 38 preschool age children, five teachers, and three additional staff members on site. Based on LPAs observation the facility was meeting the capacity/ratio requirements during this inspection. The center operates out of a one story building. The preschool program consists of four classrooms, four preschool bathrooms, dining area, kitchen, staff office, staff break room, staff restroom, and various storage areas. The program operates Monday thru Friday 6:30am -6:00pm In addition, this center has an infant program (364844264) and school age program (364844265).
Indoor/Children's Area:
Child care center was toured to ensure the center is clean, safe, sanitary and in good repair. In the area identify as the dining area, LPA observed an approximately five inch by five inch area of peeling paint on the wall. LPA also observed the flooring in the dining area was starting to peel due to a water leak in the winter storm. LPA advised the Center to monitor the flooring to ensure the area does not pose a potential tripping hazard to the children or staff. LPA observed the white sink in classroom 4 had brown residue on the sides and base of the bowl. The faucet in the bathroom of classroom 4 was leaking and there was a white plastic container placed under the sink pipes which was brown with residue. LPA observed the ceiling in room 3 was leaking drops of water into the light fixture and onto the floor. Based on theses observations, the center was not clean, safe, sanitary and in good repair at all times therefore a type B citation was issued, refer to LIC 809D.
Cleaning compounds were observed in a locked storage area near the staff break room. In a cabinet in the laundry area, LPA observed laundry soap, bleach, Ajax, dishwashing soap and additional disinfectants. The cabinet was not equipped with a child safety lock or other mechanism to make the items inaccessible to the children in care. The laundry soap was stored on a lowest shelf of the cabinet. LPA observed the children walk past this unlocked cabinet under the supervision of a teacher on the way to the dining area for lunch. This posed a potential risk to the children in care and a type B citation was issued.

Based on observation, the licensee did not comply with the section cited above when two containers of diaper cream (Non prescription medication) labeled "keep out of reach of children" were stored in the children's diaper bins in the bathroom of classroom 2. The diaper bins were stored in a shelving unit that was accessible to the children as the bins were located less that 35 inches off the ground, which poses/posed a potential health, safety or personal rights risk to persons in care.

LPA observed three empty soda cans, a spray paint can, dried palm fronds, prickly weeds, papers, empty chip bags, a used sucker, and additional debris to the back of the outdoor play space. All items were accessible to the children in care. which poses/posed a potential health, safety or personal rights risk to persons in care.

Classrooms were free of flies, other insects and rodents. The classrooms had tables and chairs to meet the children's needs. LPA observed the Center had a variety of art supplies, dramatic play equipment, books, blocks, and a wide variety of additional educational materials. During the tour of classroom 2, LPA observed two containers of diaper cream (Non prescription medication) labeled "keep out of reach of children" stored in the children's diaper bins in the bathroom. LPA observed the diaper bins were stored on a shelving unit that was accessible to the children as the bins were located less that 35 inches off the ground. The diaper cream was moved to a high inaccessible location right away. The diaper creams were accessible to the children in care, this was a potential risk therefore a type B citation was issued.
Children's belongings are kept in cubbies labeled with the children's names. LPA observed the cubbies had areas where the paint was peeling and was showing signs of wear. LPA advised the facility representative to monitor the cubbies and ensure they were maintained in good condition. LPA observed five plastic containers containing children's bedding had tipped on the side and was coming into contact with other children's bedding. LPA and facility representative discussed this observation and LPA provided technical assistance regarding how the regulations can be met. A advisory notice was issued.
Drinking water was available indoors via a pitcher of water and cups. According to facility representative, when the classrooms go outside, the teacher takes a pitcher of water and cups. However, LPA observed a classroom on the playground. Cups and water were not readily accessible to the children. LPA reminded the facility representative that drinking water shall be readily available to the children both indoor and out. LPA reminded the staff that children shall be free to drink as they wish. An advisory notice was issued.
LPA observed carbon monoxide detector, smoke detector and multiple fire extinguishers located throughout the Center. There are four bathrooms in the preschool center. Each bathroom has two toilets and at least one sink. One toilet in classroom 2 and one toilet in classroom 4 were not working at the time of this inspection. Per facility representative, a plumber has been contacted to fix the problem with the toilet. LPA observed soap and toilet paper and paper towels readily available.
There was working telephone service within the preschool. There is an isolation area for children who become ill. The facility maintains a comfortable temperature at all times. LPA observed the centers sign in/out sheets, which are completed daily. Smoking is prohibited on the premises. Teachers conduct daily inspection for illnesses. LPA did not observe prohibited childcare items during this inspection. Firearms/weapons are not allowed or stored on premises. The Center provides two meals and one snack a day.

Napping
LPA observed the children sleeping on cots. LPA observed that the cots used for napping had tears in the material and the cots were observed with loose strings. Per conversation with the facility representative, new cots have been ordered and are being assembled. LPA observed the boxes of new cots for the program. A advisory notice was issued.
Outdoor
LPA inspected the outdoor play space for health, safety, cushioning material, good repair and age appropriateness. The Center has a large outdoor place space for the infants, 2 year old preschoolers and school age program. The outdoor play space is enclosed. LPA observed, tables, chairs, swings, slides, and climbing structures. The climbing structures were placed sand and were secured to the ground. During the tour of the outdoor play space, LPA observed four wood boards in the outdoor activity space. Two of the boards had nails/screws with a sharp edges. Per facility representative work was completed on the roof over the weekend and the crew left some of their materials out. LPA observed three empty soda cans, a spray paint can, dried palm fronds, prickly weeds, papers, empty chip bags, a used sucker, and additional debris to the back of the outdoor play space near the baseball and basketball area. All items were accessible to the children in care. Facility representative stated the children do not go the the back part of the outdoor play space however LPA observed a barrier was not present to prevent the children from accessing this area. A Type B citation was issued.
Health Related Services
This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. LPA reviewed ten child records and six staff files. Based on LPA review staff and child files were complete and contained all required information.

Facility Records


LPA and facility representative reviewed the LIC 311A Records To Be Maintained At The Facility. LPA observed a current roster, fire/disaster drill log (last drill completed January 2023). A staff member was on site who had a current CPR/First Aid. The facility has completed the required Lead testing. LPA reviewed the emergency disaster plan, earthquake preparedness checklist.
Posting Requirements
The following were observed posted as required: facility license, Personal Rights (LIC613A), Parent’s Rights Poster (PUB 393), car seat law (PUB 269).

Facility representative was advised of the requirement to report Unusual Incidents. Facility representative informed to utilize the Unusual Incident Report/Injury Report LIC624 when submitting the report to the department (email address unusualincidentreport@dss.ca.gov). A report shall be made to the department by telephone or fax during the department's normal business hours before the close of the next working day following the occurrence during the operation of center. In addition, a written report shall be submitted to the department within seven days following the occurrence of any events specified above. The On-Duty Worker is available for questions at (661) 202-3318 Monday through Friday 8am-5pm.

Any duly authorized officer, employee, or agent of the Department shall, upon presentation of proper identification, shall inspect the facility. The Center shall permit the Department to inspect the child care center and to privately interview children or staff, to determine compliance with or to prevent violations of child care laws or regulations, also enter and inspect any place providing personal care, supervision and services at any time, with or without advance notice, to secure compliance with, or to prevent a violation.

Facility representative was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
