It was also disclosed, the subject child pushed another day child off play equipment, and the subject child allegedly touched other day children’s body parts above their clothes, without making skin contact. Facility records revealed multiple incidents occurred and were documented by staff from February 02, 2024, through January13, 2025. It was discovered, some occasions during February 02, 2024, through January13, 2025, documented the subject child hit other day care children twice in the same day. Pertinent parties stated they witnessed some of the incidents occurring, involving the subject child. Furthermore, it was stated some incidents involving the subject child’s concerning behavior were not documented by staff.
It was disclosed during the investigation, that the facility made several attempts in the past few months with the subject child’s authorized representative to address the recurrence of incidents involving the subject child’s aggressive interaction with other day care children, by recommending resources and guidance to the subject child’s authorized representative. However, the facility did not establish a plan of action requesting the subject child’s challenging behaviors be professionally evaluated and obtain professional resources until January 2025. Lastly, it was reported the subject child identified is no longer enrolled in the program.
Based on interviews with pertinent parties and records obtained throughout the investigation, the department has determined the preponderance of evidence standard has been met, therefore the allegation of personal rights is found to be SUBSTANTIATED. LPA Taityana Benson informed licensee Director Rosa Guzman, that this report dated 02/07/2025 documents a Type A citation which shall be posted for 30 consecutive days as there is an immediate risk to the health, safety, or personal rights of children in care.
A notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.
Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
