32 | It was reported, on 05/01/2025, through an ouch report that a day care child walked into a pole in the playground that resulted in a red mark on the left eye. The incident took place in the morning. The teacher who was outside in the playground with the classroom did not observe the incident occur. The teacher only found out the child had walked into the pole because the child made a grunt like noise and began to hold his left eye. The teacher did not observe any bruising or marks but the child's left eye area turned red. Through video footage obtained, LPA observed the child walk into the pole and the teacher's back was turned towards the child. After the child walked into the pole, the teacher was seen turning around and walking towards the child. Around pick-up time on that day, two teachers stated the red mark around the left eye was no longer visible. The following day, on 05/02/2025, during drop off, the teacher received the child at the classroom door and did not observe any bruising or marks on the child's left eye area. Later that day, when the parent went to pick up the child around 01:00 PM, the parent noticed what they described as three (3) "finger" marks on the child's left eye area that ran diagonally from the eyebrow to the corner of the eye. When the parent questioned this, the teacher was not able to give a response on how the child obtained those marks. The teacher stated it could have happened because the child slept on their own hand during nap time. The teacher also stated it could have happened because the child lays on the floor often but was not able confirm exactly how the child obtained the three (3) marks. Although video footage was obtained and reviewed for this incident, it was still unclear as to how the child got the marks or what time of day the incident occured.
Additionally, on a separate occasion, a photograph was obtained that showed a teacher laying on the playground slide with a phone in their hand. In the same photograph, it shows children present in the background and another child on top of the slide.
Based on LPA observation of photos, interviews and record review, the preponderance of evidence standard has been met, therefore the above allegation(s) is found to be SUBSTANTIATED. California Code of Regulations, (Title 22, Division 12 & Chapter 1), are being cited on the attached LIC9099D.
