25 | On 01/04/24 @11:40 a follow up case management inspection is being conducted by License Program Analyst (LPA) Blanca Ruiz in response to the receipt of an unusual incident report (UIR) from the facility. LPA met with licensee, Yiting Yang and licensee’s assistant Samantha Gonzales. Facility was toured and census was taken. Facility served children ages 21 months to 5 years old. During inspection conducted on 12/22/23 records were reviewed, and interviews were conducted with pertinent parties. UIR indicates that on 11/21/23 and 11/22/23 licensee called a police officer to come to the facility to speak with the parent/legal guardian of Child#1 regarding and alleged incident pertaining to the child in question. The incident was dismissed by police on 11/22/23. The facility was closed when the incident occurred, and no children were present. UIR was a self reported incident ant it was submitted to Community Care Licensing (CCL) in a timely manner.
Per information obtained regarding the alleged incident, a parent/legal guardian of Child#1 removed child from daycare on 11/13/23, but few days later parent returned to the facility on 11/21/23 and 11/22/23 stating that child was hit by licensee while in care. Licensee spoke with parent/legal guardian and denied the allegation, explained daycare and licensing regulations. Attempts to contact the parent/legal guardian of the child to obtain additional details were made unsuccessfully. Child#1 was not available for interview and is no longer in care.
Staff and child(ren)interviews were conducted and facility records were reviewed during 12/22/23 and 01/04/23. Children interviews revealed feeling happy and safe while in care. Based on the information gathered, there was not substantial evidence that a violation of Title 22 regulations occurred as alleged; therefore, no violation(s) have been identified pertaining to this matter.
An exit interview conducted, and report was reviewed with licensee, Yiting Yang. Appeal rights were discussed, and A Notice of Site Visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
