On August 16, 2022, Licensing Program Analyst (LPA) Heriberto Perez conducted a follow-up complaint inspection to the above facility and met with Kitty Thompson, Social Worker Supervisor. The purpose of the inspection was to deliver the finding for the above complaint allegation.

During the course of the investigation, LPA interviewed Resource Parents (RPs) and one adult on 04/07/22 , LPA interviewed Agency Social Worker (ASW) on 04/12/22, LPA interviewed one child via telephone on 08/11/22 and LPA interviewed two children on 08/12/22 (see Confidential Names Form LIC 811 dated August 16, 2022). LPA also reviewed documents including but not limited to RFH Written Report, Approval Certificate, Child's Need and Service Plan, Special Incidents Reports, placement history and County Investigation Report.

It was alleged Resource Parent hit minors while in care and Resource Parent speaks to minor in an inappropriate manner.

The Resource Parents (RPs) denied the allegations and stated that the children were not hit or spank while in care. RPs stated that the children were discipline by taking away things like the electronics. RPs stated that the children were not told that bad kids go to jail or juvenile hall. Other statements indicated that the kids were not hit and that the children were not told that they would go to juvenile hall. Information revealed that the television was taken away as a form of discipline and the children fought and hit each other.

The confidential interviews did not corroborate the allegations, interviews revealed contradicting and inconsistent statements in regards to the allegations. There were statements indicating that the children were hit or thrown to the wall by the RPs and there were statements indicating that the RPs did not hit the children and that the electronics were taken away when the children got in trouble. Other information indicated that the children were told that bad kids go to juvenile hall and other information indicated that the children were not told that bad kids go to juvenile hall or jail. The Agency Social worker indicated having no concerns with the care and supervision in the home and the County Social Worker was not available to give a statement. The alleged violation occurred when the children were placed in the home from 05/04/18 to 05/07/21 and was reported to the Department on 04/04/22. LPA did not find corroborating evidence to substantiate the allegations.

Based on the interviews and records reviewed, the allegations are found to be unsubstantiated. Although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove the allegations. Copies of LIC9099, LIC9099C, LIC811 and Appeals rights were provided and discussed with the facility representative mentioned above. There were no deficiencies cited.
