On 8/30/2022 Licensing Program Analyst (LPA) Zirbes, conducted a Case Management inspection with Licensee, Linda Brassfield. The purpose of the case management inspection was to assess the home for a capacity increase and ensure the facility meets basic licensing requirements set forth by Title 22, Health and Safety and statutory requirement. The licensee is requesting to provide care for a Large family childcare home (FCCH) for the capacity of 14 children. Fire clearance was granted on 8/19/2022. During the inspection, one child (23 months) was present. When LPA arrived to the home, Adult 1 (A1) was providing supervision to the one child care child. The Licensee was away from the home when LPA arrived. Per LPA record review and Licensee statement, A1 does not have current CPR/First Aid training. Per licensee, currently residing in the home is licensee, and A1.
The home is described as follows:
This is single story home with three bedrooms, three bathrooms, laundry room, kitchen, living room, dining room, family room, day care room and front and backyard. Per Licensee, the Daycare room, family room, backyard, dining room, kitchen and the bathroom located within the day care room are utilized for the family child care activities. The off-limits areas consists of: all three bedrooms, two bathrooms (located down the hallway), laundry room, and living room. The off limits areas were inaccessible doors. LPA reminded the Licensee to ensure all off limits areas are inaccessible to the children in care during operating hours. Parents and children gain access to child care via an entrance on the side of the home. Parents and children enter directly into the day care room. The home has central heating and air conditioning.
Indoor:
Daycare room: LPA observed, toys, games, books and a television. The shelving units were secured to the walls. Age appropriate furniture was observed in the room, which included a couch, child size table and chairs. A changing table was located in this room as well. Required posting were on the wall of the room. Per Licensee this area will be the primary area for child care activities.
Bathroom: Located near the day care room. The bath had a toilet and sink, which were in working order. No cleaning products or medications were stored in this area. Report continued on page two

Family Room: The room was furnished with couches, a fire place, storage areas and a bar. At the time if this inspection the alcohol was accessible to the children in care. Licensee put up a child safety gate up during the inspection which made the alcohol inaccessible. LPA reminded the Licensee that alcohol had to be inaccessible to the children in care. Per Licensee this area is used for napping. LPA observed two play yards in this room. The fire place was accessible to the children in care at the time of this inspection however per Licensee the fire place is not utilized during child care hours. Licensee will purchase a barrier to prevent the children from accessing the fireplace.
Kitchen: The refrigerator, dishwasher, stove, microwave, etc., are clean. The kitchen was clean, orderly, and free of hazardous items. The Licensee prepares meals and snacks for the children in care. The knives were stored in the off limits laundry room which is located off of the kitchen.
Dining Room: Furnished with a table and four chairs.

Outside: The entire back yard is on limits. LPA observed a covered patio, dramatic play house, tiny tikes play equipment, and an empty water table. The backyard is enclosed with brick fencing. LPA observed the trees and bushed were properly maintained.
Napping equipment: LPA observed two play yards and five mats. Per Licensee, the children will nap in the daycare room and the family room. Licensee stated they are willing to purchase additional napping equipment if necessary to met the needs of the children in care.
Electrical outlets: All unused electrical outlets are plugged in and made inaccessible to children.
Weapons or Firearms: Per Licensee, there are firearms in the home. Based on LPAs observation the gun and the ammunition were stored and locked separately at the time of this inspection.
Cleaning compounds: Stored in a high cabinet in the the off limits laundry room. The laundry room is equipped with a door that makes the area inaccessible. LPA reminded the Licensee that the child care license allows the provider to care for children up to the age of 12. Therefore, the licensee had to ensure all cleaning products were inaccessible to children of all ages.
The smoke detector and a carbon monoxide detector: located throughout the home. The home has a pull down fire alarm in the day care room. Items were operable.

Fire extinguisher (2A10BC) There was a fully charged fire extinguisher (2A10BC); which meets fire marshal standards located in the day care room. .
Pet: The family has one dog who are current on shots. Per Licensee, the dog does interact with the child care children.

Living room (Off limits): This room is located near the front door. This area was furnished with couches, fireplace, and television. The room is inaccessible to the child care children via doors.

Laundry room (Off limits): This room is located kitchen. The laundry was made inaccessible to the children via a door.
Bedroom #1 (Master Bedroom and Bathroom) (Off limits): The bedroom was furnished with bed, and personal belongings. The room is off limits via closed doors which prevent the children from gaining access to the bedrooms.
Bedroom #2: (Off limits): The bedroom was furnished with bed, office space and personal belongings. The room is off limits via key locked door.
Bedroom #3: (Off limits): The bedroom was furnished with bed, and personal belongings. The room is off limits via closed doors which prevent the children from gaining access to the bedrooms.
The following was discussed with the licensee:
Licensee reminded that 100% supervision is required at all times to children in care. Licensee was made aware that it is he/her responsibility to know the regulations as well as anyone who assists in providing care. Licensing must have the facility’s phone number at all times; if the phone number is changed, licensing must be notified
The regulation prohibits the smoking of tobacco in a private residence that is licensed as a family childcare home and in those areas of the family day care home where children are present (24/7 ban). State law prohibits baby walkers, bouncy seats, exersaucers, and any other items that fall into that category.

On January 1, 2018, or before March 30, 2018, a person who is a licensed childcare provider, administrator, or employee of a licensed child day care facility shall complete the online mandated reporter training and shall complete renewal mandated reporter training every two years. @www.mandatereporterca.com

**Senate Bill AB 633 - Child Care Facilities: Parent Notification Requirements


Summary: This bill amends Health and Safety Code (HSC) sections 1596.859, 1596.8595, 1596.8895, and 1597.05 to improve the transparency of licensing records and to ensure that parents/guardians using a licensed childcare facility are aware of situations that present the greatest danger to children.

Licensee was reminded that all adults 18 and over living in the home, persons who provide care and supervision to children, and staff who have contact with children, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

LPA reviewed the Licensee file and one child file. All required forms were within the files at the time of this inspection. Per LPAs review the Licensee CPR/First Aid expires 06/07/2023

This facility provides Incidental Medical Services – IMS. LPA reviewed storage of medication and equipment/supplies, and reviewed children’s, personnel, and administrative records. LPA and Licensee discussed the large family home capacity regulations. LPA also discussed the personal requirements for the new staff person.

The following citations were issued today:

Based on LPA observation, record review and statement from the Licensee. Adult 1 was providing supervision to C1 when LPA arrived to the home. A1 does not have a current CPR/First Aid training therefore the facility was cited a type B citation for regulation 102416 (c) Personnel Requirements.

Based on LPA record review and statement from the Licensee, the Licensee does not have current mandated reporter training. A type B citation was issued for Health and Safety regulation 1596.8662 (b)(1) Administration of Child Day Care Licensing

LPA also provided advisory notices for the following 102417 (g)(1) Operation of a Family Child Care Home.

As a result of this inspection, the home does not meet Title 22 Regulations. Capacity increase is pending clearance of the cited deficiencies and final approval from the Licensing Program Manager.

Exit interview conducted and report was reviewed with the licensee Linda Brassfield.
