On Thursday July 3, 2025, Licensing Program Analyst (LPA’s) Giovanni Cristales and Justeene Tamayo met with licensee Krystal Cendejas. The purpose of the inspection is to conduct an Annual Inspection. Licensee is licensed to provide care and supervision for a Large Family Child Care for a capacity of up to 14 children. Present during the time of this inspection are the licensee, Spouse and (8) daycare children, Per the licensee, all adults residing in the home have a Criminal Record Clearance. LPA’s toured the areas of the home. Hours of operation are Monday – Friday 4am – 10pm, weekends as needed. Upon arrival there is one infant and 7 preschool age children, along with assistant #1.

This is a two- story home with 3 bedrooms, 3 bathrooms, kitchen, dining area, living room, family room, garage, laundry room, front and back yard/pool. The main area of care is conducted in the living room, children use 1 bathroom located downstairs, and the front yard.

Off-limit areas - 3 bedrooms (Upstairs), 2 bathrooms, laundry, garage and all Backyard/pool area. There is a fireplace located in the living room which is inaccessible to children with a glass barrier locked.

The home was inspected inside and out for safety, comfort, cleanliness, telephone service, heating and ventilation, poisons, detergents/cleaning compounds, medicines, and hazardous items that can pose a danger to children, LPA’s observed all items are made inaccessible to children during the time of this inspection. LPA’s observed age-appropriate safe toys inside the home and napping equipment on the premises. Per the licensee, children nap in the living room. LPA’s observed 18 cots, and 2 playpens, enough for children to rest. LPA’s observed 1 high chair, and 1 table with 3 high chairs built in, and three lunch tables. LPA’s observed all electrical outlets made inaccessible to children with safety covers. There are no window string/cords accessible to children. Per the licensee, there are no weapons or firearms on the premises. There is a swimming pool or bodies of water on the premises. (Off-limits Backyard)

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

Bathroom: It was observed to be clean, with soap, toilet paper, functioning faucet sink (cabinets underneath, locked), flushing toilet, and there were no hazards. The following are inaccessible: Sharp items, mouthwash, shampoo, razor, and nail polish.

Kitchen: Sharp items (knives in kitchen cabinet upper right cabinet) are inaccessible, and the home has a clean fully stocked food refrigerator/freezer. No chemicals in the kitchen were observed to be accessible. LPA’s observed chemicals on top cabinet above to the left of the refrigerator. Licensee serves Breakfast, lunch, dinner, and snacks.

Outdoor: The LPA’s toured the front yard (open, no fencing) and observed age-appropriate play equipment, the surface is covered with grass and cement. LPA’s reminded licensee to make sure children are always being supervised. LPA’s observed an in-ground pool in the backyard. LPA’s observed the pool to be fenced all around and measured the height of the fence from the ground up to the top of the fence to be 5.5 ft high and fence does not obscure the pool from view. LPA’s observed the door to swing away from the pool and the self-latching device is no more than 6 inches from the top of the gate. LPA’s observed the bottom of the fence to reach the cement floor.



According to the new AB-2866 Pool safety: State Department of Social Services regulated facilities. In addition to the fencing, LPA’s did not observe a pool cover or an alarm that, when placed in a swimming pool, will sound upon detecting an entrance into the water. Per licensee an alarm is being purchased soon (technical violation given). LPA’s observed a life ring with a minimum exterior diameter of 17 inches but no labeled as approved by the United States Coast Guard (technical violation given), and a rescue pole with a body hook and a minimum fixed length of 12 feet. Licensee will provide a daily inspection log (technical violation given) which ensures of the drowning prevention safety features and safety equipment before opening the facility. LPA’s reminded applicant, the mesh fencing must not be removed and no ladders or any climbing equipment near the fencing. LPA’s informed applicant, if in the future the fencing needs to be replaced, applicant will need to contact the department to notify about the change.

Advisory/Other: First Aid kit was observed with supplies readily available. The licensee has CPR/First Aid expired: 04/20/2025. Facility has been cited a Type B Citation. Please see LIC809-D for deficiency page. Licensee will submit proof of current Pediatric CPR/First aid and send proof of completion to LPA Cristales no later than 08/03/2025.

Mandated Reporter expires: 01/19/26. LPA’s observed required fire extinguisher (2A10BC) was fully charged, and smoke detectors and carbon monoxide devices were tested operable. The First Aid Kit was observed complete with supplies and a first aid manual. Licensee has proof of being immunized against influenza, pertussis, and measles.

Per the licensee, transportation is being provided for children. LPA’S observes the licensee’s valid California driver’s license with an expiration date of 01/08/2026, vehicle insurance with an expiration date of 09/16/2025, and vehicle registration with an expiration date of 02-12-2026.

LPA’s reviewed 3 children’s records, LPA’s reviewed the childcare facility roster, and fire drills/ earthquake drills log, and documentation for both and conducted on 06/10/2025.

Per licensee, their no sleep log. LPA’s reminded licensee that sleeps log is required every 15 minutes for children 0 - 2. Facility has been cited a Type B Citation. Please see LIC809-D for deficiency page. Licensee will ensure she is completing the log every 15 minutes and will send LPA Cristales a copy no later than 07/10/2025.

Incidental Medical Services (IMS) were discussed. Per the licensee, the facility is not currently providing IMS. LPA’s informed the licensee to refer to IMS information in the Evaluator Manual – Regulation Interpretations and Procedures for Family Child Care Homes Section 102417. When any IMS is provided, a Plan for Providing IMS must be submitted to the Department. The following information regarding ADA was provided: US Department of Justice (USDOJ) toll-free ADA Information Line at (800) 514-0301 (voice)/ (800) 514-0383 (TTY) and link to the publication: Commonly Asked Questions about Child Care Centers and the ADA, available at: http://www/ada.gov/childqanda.htm.

The following information was discussed with the licensee:

· Mandatory Forms for the children’s files and provider’s files.

· Requirements for fire drills, earthquake drills, and documentation for both. The last fire/earthquake drill was completed on 06/10/2025, LPA’s advised the licensee to conduct a disaster drill every six months.

· Role and responsibilities of being a mandated reporter were discussed.

· Licensee was made aware that it is their responsibility to know and review updates/regulations and forms online at www.ccld.ca.gov as well as anyone who assists in providing care.

· The licensing department must have the facility’s phone number. If the phone number is changed, the licensing department must be notified.

. Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

· On January 1, 2018, or before March 30, 2018, a person who is a licensed childcare provider, administrator, or employee of a licensed child day care facility shall complete the online mandated reporter training and shall complete renewal mandated reporter training every two years. @www.mandatedreporterca.com

· AB 290 - for each new license issued, at least one director or teacher at a childcare center or family child-care home shall have at least one hour of childhood nutrition training.

· **Senate Bill AB 633 - Child Care Facilities: Parent Notification Requirements

· Summary: This bill amends Health and Safety Code (HSC) sections 1596.859, 1596.8595, 1596.8895, and 1597.05 to improve the transparency of licensing records and to ensure that parents/guardians using a licensed childcare facility are aware of situations that present the greatest danger to children.

· Each report (documenting a Type A citation) shall remain posted for 30 days along with the Notice of Site Visit. **In addition; A copy of this report must be provided to the authorized representatives of all currently enrolled children and any newly enrolled child for the following 12 months.

· The ACKNOWLEDGEMENT OF RECEIPT OF LICENSING REPORTS (LIC9224) shall be signed and kept in each of the children’s records. The report shall be provided no later than the next business day or the next day the child is in care.

· Failure to meet the posting requirements shall result in an immediate $100.00 civil penalty

· Licensee is made aware that Title 22 Regulation prohibits the smoking of tobacco in a private residence that is licensed as a family child-care home, and in those areas of the family day-care home where children are present.

**§1597.622 Employees or volunteers at a family day care home; immunization requirements; records; exemptions (a) (1) Commencing September 1, 2016, a person shall not be employed or volunteer at a family day care home if he or she has not been immunized against influenza, pertussis, and measles. Each employee and volunteer shall receive an influenza vaccination between August 1 and December 1 of each year.

· State law prohibits baby walkers, bouncy seats, exersaucers, and any other items that fall into that category.

. Safe Sleep: LPA’s discussed the safe sleep regulations with the licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource.

LPA’s also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

· Lead Poisoning: For more information, visit the California Childhood Lead Poisoning Prevention Branch’s website at www.cdph.ca.gov/programs/clppb,or, call them at (510) 620-5600.

· Licensee advised visit www.shotsforschool.org for Immunization information.

· Child Care Advocates: You can now sign up for Quarterly Updates and PINs for one or more programs through our DSS website at www.ccld.ca.gov. Click on “Receive Important Updates” located in the right middle part of the page, immediately above the Quick links. Put your email address and choose which program(s) you would like to subscribe to and click “subscribe”.

Deficiencies Cited: two deficiencies are being cited in accordance with Title 22 of the California Code of Regulations and/or Health & Safety codes. See LIC 809D. LPA’s Issued 3 Technical Violations.

Notice of site visit was given and must remain posted on, or immediately adjacent to, the interior side of the main door for 30 days.

Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

An exit interview was conducted, and the report was reviewed with the licensee Krystal Cendejas, along with a copy of her appeal rights and Notice of Site Visit.
