On June 25, 2024, at 11:00 a.m., Licensing Program Analyst (LPA) Zirbes met with Licensee Sulani Nesbitt who guided analyst on a tour of the home for the Annual/Random inspection. Upon arrival, LPA observed five children in care with the Licensee and staff 1 (S1) providing supervision. Based on LPA observation, the child care was meeting the staffing/ratio requirements at the time of this inspection. According to the Licensee currently living in the home are the Licensee, Adult 1, and three minor children (14, 11, 6). All adults are associated and have eligible clearances. Current hours of operation are Monday to Friday 6:00am - 4:30pm during the summer and 6:00 am - 6:00 pm during the school year.
Physical Plant: This is a single story house with four bedrooms, two bathrooms, kitchen, living room, dining area, attached garage, front yard and backyard with a pool Per Licensee the on limit areas are the living room, dining area, kitchen, hallway bathroom and the backyard. The off-limit areas of the home are all the bedrooms, garage, and bathroom located in primary bedroom. The off limit areas of the home were inaccessible via child safety gate.
The home was inspected inside and out for safety, comfort, cleanliness, telephone service, heating and ventilation, inaccessibility to poisons, detergents/cleaning compounds, medicines and hazardous items that can pose a danger to children. During the inspection, LPA observed cleaning products in the cabinet under the kitchen sink. The cabinet was equipped with a child safety lock, therefore the cleaning products were inaccessible. Household medication are stored in a kitchen cabinet equipped with a child safety lock. Per Licensee, zero medications are currently being provided to the child care children. Knives and sharp items were stored in on top of the refrigerator which is inaccessible to the children in care. LPA observed a smoke detector in the dining area of the home and a carbon monoxide detector in the hallway of the home. The detectors were tested and found to be in working order at the time of this inspection. The home does not have a fireplace. LPA did not observe baby bouncers/saucer chairs, or any recalled and or prohibited toys on the premises. Per Licensee, there are zero firearms or weapons stored in the family child care.

According to the documentation the fire extinguisher was purchased in March 2024. Therefore the fire extinguisher meets the state fire marshal standards.
Bathroom: (located in the hallway of the home). Toilet, sink, shower/tub were clean and operable. At the time of this inspection LPA did not observe cleaning products or personal hygiene materials in accessible areas to the children. The wall heater was inaccessible.
Outdoor: The outdoor space consists of areas of cement and grass. There are two locked storage sheds in the outdoor space with household materials. There is a in-ground pool in the backyard. The in ground pool is surrounded by a 5’ removable mesh fence that is mounted into concrete.  The gate opens away from the pool. At the time of this inspection the latch for the pool gate was not self latching. According to the conversation with the Licensee, the self latching mechanism broke on 6.20.24. The Licensee ordered a replacement part however the part was the wrong size. A second replacement part has been ordered and should arrive in the next few days. LPA observed the gate was locked with a child safety lock therefore the pool was inaccessible at the time of this inspection. LPA advised the Licensee to submit an incident report in the future to document any variations of the pool fence regulations. A technical advisory notice was issued since the self latching mechanism was not in working order at the time of this inspection. Per LPA review, there are no items around the perimeter of the fence that would allow the fence to be climbable.  The licensee understands and agrees that the fence will remain in place whenever licensed care is provided.

Per Licensee, the only pets on the property are fish.
LPA reviewed five child files, the Licensees file and one assistants file. Based on LPA record review one of five child files was missing documentation of their immunization's. In addition, LPA observed the Licensee was not utilizing the PM 286. LPA advised the Licensee of the requirement and advised the Licensee to download a current PM 286 from the Department of Public Health website LPA reviewed one infant file, per LPAs review the total time of the infants nap was being recorded not the time of each 15 minute check. LPA clarified the requirement with the Licensee. Three technical advisory notices were issued regarding the child files. Per LPA record review the Licensee and assistant did not complete the two year renewal of the mandated reporter training as required. The Licensees mandated reporter expired in March 2024 and the assistants training expired in April 2024. Per LPA review the Licensee and assistants CPR/First aid training expired in February 2024. Review of records to be maintained: LPA reviewed with licensee the LIC 311D, Forms/Records To Keep In Your Family Child Care Homes, children’s forms/records, facility forms/records, and information to be posted. The following was discussed with the licensee:


Licensee was informed of the MyChildCarePlan.org website; a consumer education website that helps families obtain child care by connecting them to child care providers and Resource and Referral Agencies (R&Rs) throughout California.

LPA discussed the safe sleep regulations with licensee and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-andresources/
safe-sleep as an additional resource. LPA also informed licensee of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.

Licensee was reminded that all adults 18 and over living or working in the home, including employees and volunteers, except as specified in Health and Safety Code section 1596.871, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a licensed Family Child Care Home. A civil penalty of $100.00 minimum/day for a maximum of 5 days or, if the penalty is for a repeat violation, for a maximum of 30 days per person will be assessed if this regulation is violated.

During the exit interview, the Licensee Sulani Nesbitt, confirmed that there are no Registered Sex Offenders living in the facility and LPA completed the RSO profile in FAS.
