On April 11, 2025, at 02:10 Licensing Program Analyst (LPA) Kendal Zirbes met with facility representative Josie Hernandez. The purpose of the inspection was to deliver the finding for the above stated allegation.  During the investigation, LPA Zirbes and Cha conducted parents, and staff. Interviews with children were not conducted due to the age and development of the children in care. In addition, LPAs completed a review of the facility records and conducted unannounced inspections on January 31, 2025, March 13, 2025, and April 2, 2025.
On January 29, 2025, the Department received an allegation alleging the crickets 2 classroom was dirty and never sanitized by staff 1 (S1) and staff 2 (S2). Parents reported conflicting information. Some parents reported zero concerns with the cleanliness of the classroom while others reported the classroom smelled and their children were often sick. Parents reported they have observed the staff vacuuming and mopping at pick up and drop off. Staff interviews also reported conflicting information as staff reported the carpet is not vacuumed and pieces of paper and debris are left on the carpet and accessible to the children.

Others reported they clean and disinfect every day. LPAs completed an unannounced inspection on January 31, 2025, March 13, 2025, and April 2,2025. During two inspections, LPA Zirbes observed the black portable handwashing sink was not operational therefore handwashing was not readily accessible during diaper changes. During one inspection the portable handwashing sink did not have water and during the other inspection the handwashing sink was not plugged into a power source. Photographic evidence was received documenting the low mirror in classroom had smudge marks from the children’s hands and was therefore not clean and sanitary. The portable sink had soak residue and debris from past handwashing’s and was therefore not clean and sanitary.
Based on record review, LPA observations and information obtained through interviews the preponderance of evidence standard has been met for the following allegation: Staff do not ensure facility classroom is clean and sanitized. Therefore, the above allegation is found to be Substantiated. The following citation was issued on the LIC 9099D for California Code of Regulations, Title 22, Division 12, Chapter 1, regulation 101438.1 (c) Infant Care General Sanitation.
A Notice of Site Visit was given and must remain posted for 30 days. An exit interview was conducted, and the report was reviewed with facility representative Josie Hernandez. Appeal rights and a copy of the report were provided to facility representative Josie Hernandez_.

Per facility representative the daily checklist is being completed by teachers and the director is completing a daily environments check as well. The Center will send the Department a copy of the daily checklist every Friday for the next two weeks.

Interviews with children were not conducted due to the age and development of the children in care. In addition, LPAs completed a review of the facility records and conducted unannounced inspections on January 31, 2025, March 13, 2025, and April 2, 2025.
On January 29, 2025, the Department received an allegation alleging staff 1 (S1) and staff 2 (S2) are always on their phones and are therefore not providing supervision to the children. Parent interviews did not report concerns with the staff members and expressed the staff send updates of the children throughout the day using their phone or iPad. Staff interviews provided inconsistent information as some staff reported S1 and S2 were on their phones too often and while others denied the allegation.

A second allegation was received alleging S1 and S2 leave day care children in soiled diapers for extended periods of time. Parent interviews did not report concerns with the diaper changing process, and expressed their children have not received diaper rashes while in care. Staff interviews provided inconsistent information as some staff reported S1 and S2 left the children in soiled diapers for an extended period of time and other denied the allegations and reported diapers are check every hour.
A third allegation was received alleging S1 and S2 leave day care children sitting at facility tables for an hour or more. Parent interviews did not report concerns and expressed they have observed their children playing or interacting with S1 and S2. Staff interviews provided inconsistent information as some staff reported S1 and S2 left the children sitting at the table for 30 minutes to an hour. Other staff denied the allegation and expressed the table was used when reading a book, during mealtimes and art projects. During LPAs unannounced inspections LPA did not observe the children sitting at the table for extended periods of time. However, per LPA interviews the classroom previously had a toddler seat table. This table was removed and replaced with a table and chairs. Staff interviews confirmed the classroom environment was changed to ensure the needs of the children were being met.
Based on interviews, record review and observation, there is not enough evidence regarding the allegations alleging, staff do not provide adequate supervision to day care children, staff leave day care children soiled for extended periods of time, staff leave day care children at facility tables for extended periods of time. Therefore, the allegations are deemed unsubstantiated at this time. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are unsubstantiated.
