NARRATIVE
1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25	On November 8, 2024, at 01:46pm, Licensing Program Analyst (LPA) Kendal Zirbes conducted an unannounced Case Management inspection and met with Administrator Lisa Burtner. The purpose of the case management inspection was to address information regarding an incident that occurred at the facility on an unknown date. LPA met with Administrator Lisa Burtner. Present during today's inspection were one school age children. The Department discovered through confidential interviews that on an unknown date In October 2024, staff 1 (S1) placed child 1 (C1), a school age child in a Thunder Group Highchair. The incident occurred in the classroom 3. According to the confidential interviews, C1 was in the highchair for approximately ten minutes. S1 confirmed C1 was placed in the Thunder Group Highchair due to throwing toys towards the preschool age children. Confidential interviews confirmed on a second unknown date S1 placed child 2 (C2) a school age child in a Thunder Group Highchair. Interviews stated C2 was removed from the highchair within two minutes due to a staff 2 (S2) observing C2 in the highchair and removing C2 from the highchair. S1 confirmed C2 was placed in the highchair due to playing roughly with the other unknown children in care. Administrator stated they were made aware of the incident involving C2 and S1. Administrator stated they had a verbal discussion with S1 regarding this being an inappropriate solution. Administrator did not know about the incident involving C1. Based on confidential interviews, S1s disciplinary action of restraining C1 and C2 in the Thunder Group Highchair after a challenging behavior violated C1 and C2s personal rights. The Center was issued a type A citation for California Code of Regulations, Title 22, Division 12 Chapter 1, 101223.2 (a) Discipline. Refer to the attached LIC 809D. In addition, based on the information obtained from the interviews the incidents occurred in the classroom 3 when preschool and school age children were present. The school age and preschool children were on opposite sides of classroom 3. The Center does not have a waiver to co-mingle the preschool and school age student in classroom 3. LPA issued a technical advisory notice regarding 101538.3(b) Indoor Activity Space. Report continued page two.

LPA Zirbes informed Administrator Lisa Burtner that this report dated November 8, 2024, documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Zirbes informed the facility representative to provide a copy of this licensing report dated November 8, 2024, that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

A notice of site visit was given and must remain posted for 30 days. An exit interview was conducted, and this report and appeal rights were reviewed with Administrator Lisa Burtner.
