On April 12, 2024, Licensing Program Analyst (LPA) Zirbes conducted a follow-up complaint inspection at Little Mountain Preschool. LPA met with Administrator April Dogero. The purpose of the inspection was to deliver the findings for the above complaint allegation. The investigation included an inspection of the facility, confidential interviews with staff, and parents, and a review of the facility records. In addition, the investigation included a review of photographic evidence.

On April 03, 2024, the Department received an allegation alleging that on April 3, 2024, a metal fence fell and hit child 1 (C1) on the side of the face. According to the information received, the fence located in the outdoor activity space, accessible to children was not secured and fell after C1 shook the fence. Interviewees reported the fence panel blended in with the existing fence, secured with a chain, therefore supervising staff did not notice the hazard until C1 started shaking the uninstalled fence panel causing the chain to slip off the post and the fence to fall. A staff member was able to grab the fence panel before the full weight of the metal panel landed on C1. Report continued on page two

As a result of the fence falling, C1 received injuries to the head and arm. On April 4, 2024, LPA completed an unannounced inspection at the Center. LPA observed the fence panel had been removed from the outdoor activity space. The fence panel was approximately 7' X 4'10" and made of metal.

Based on the interviews conducted and a review of the records, the preponderance of evidence standard has been met. Therefore, the above allegation is found to be SUBSTANTIATED. A type A citation was issued on the LIC 9099D for California Code of Regulations, Title 22, Division 12, Chapter 1, regulation 101238.2(h).

LPA Zirbes informed facility representative April Dogero that this report dated April 12, 2024, documents one Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care.

Also, LPA Zirbes informed the licensee to provide a copy of this licensing report dated April 12, 2024, that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

An exit interview was conducted, and this report along with the appeal rights were reviewed with facility representative April Dogero. A notice of site visit was given and must remain posted for 30 days

Per Administrator the fence panel was removed on 4/3/24. The Center has and will discuss the importance of keeping a safe environment with all outside companies who complete work on the property. Individual staff training regarding the

procedures for outdoor inspections will be completed by 4.12.24. A checklist was created for the staff to utilize during the safety checks. A copy of the completed checks will be submitted to the Department everyday for the next two weeks starting 4.15.24.

On April 12, 2024, Licensing Program Analyst (LPA) Zirbes conducted a follow-up complaint inspection at Little Mountain Preschool. LPA met with Administrator April Dogero. The purpose of the inspection was to deliver the findings for the above complaint allegation. The investigation included an inspection of the facility, confidential interviews with staff, and parents, and a review of the facility records. In addition, the investigation included a review of photographic evidence.
On April 3, 2024, the Department received an allegation alleging that Child 1 (C1) and Child 2 (C2) received injuries at the Center. When the Center was asked how C1 and C2 received the injuries, the staff reported, that they did not see what happened. Confidential interviews provided inconsistent information, as some parties reported the staff were not always supervising the children and other parties reported the children were being supervised. Staff interviews reported they use active supervision and position themselves so that they can always observe all children and redirect if necessary. Additional evidence revealed inconsistent information regarding if the injuries occurred at the Center. Facility records revealed the Center was completing incident reports. The incident reports within the facility files did not provide evidence regarding C1 and C2 reported injuries.

Based on the information obtained there is not enough evidence regarding the allegation alleging Facility staff not supervising children in care at all times. Therefore, the allegation is deemed UNSUBSTANTIATED at this time. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

Notice of Site Visit was given and must remain posted for 30 days. An exit interview was conducted, and the report and appeal rights were reviewed with Administrator April Dogero.
