32 | As a result, no corroborating statements or information were obtained to confirm that the allegation that children are allowed to remain in soiled diapers occurred while the children were in care.
Furthermore, it was alleged that the facility does not properly maintain the outdoor play area. During the investigation LPA observed barbed wire on 13 feet of fencing, across the top portion of the fence. At its lowest, the barbed wire was at 60 inches from the ground. This was determined to not be a hazarded to the preschool aged children as it is not low enough for preschool children to reach or close enough to the play structure where it can be a danger to the children in care. Director removed barbed wire during the inspection.
The allegation also stated that children were not allowed to use the climbing structure due to issues with the wood chips. LPA measured 3 slides:
Slide 1 had a 23 inches drop with cushioning material underneath (wood chips)
Slide 2 (double slide) had a 19 inches drop with cushioning material underneath (wood chips)
Slide 3 had a 23 inched drop with cushioning material underneath (wood chips)
Interviews revealed that the 2-3 year olds do not utilize the slides in the playground and that only the taller preschool children play in that area. 2-3 year olds are to remain in the smaller play structure or in the sand box.
Based on the inconsistent and insufficient evidence obtained during the investigation, the allegations that the facility did not meets children's diapering needs and that the facility does not properly maintain the outdoor play are deemed unsubstantiated.
A finding that a complaint is Unsubstantiated means that, although the alleged conduct may have occurred or the allegation may have some validity, the evidence obtained during the investigation does not establish, by a preponderance of the evidence, that the alleged violation occurred.
An exit interview was conducted. A copy of this report was reviewed with and provided to the facility on this date, along with a copy of the appeal rights and Notice of Site Visit. |
