Licensing Program Analyst (LPA) Renita Hall, conducted an unannounced visit to initiate a complaint investigation and deliver findings regarding the above-mentioned allegations. LPA was allowed entry by Roger Hernandez, Administrator. LPA identified herself and disclosed the purpose of the visit and elements of the complaint to the Administrator.

During today’s visit, LPA conducted interviews with staff, obtained records, and a tour of the facility. On May 9, 2024, the Department received a complaint regarding the following allegations: Unlawful eviction and staff did not allow the client to enter the facility.

Allegation 1: Unlawful eviction. Resident 1 (R1) had lived at the facility since June 2023. (R1) was given an eviction on November 8, 2023, and was due to vacate the premises on or by 12/8/23 R1 refused to sign "nice try buddy the Sheriff has to serve me."

A second notice to vacate was given on December 11, 2023, and R1 refused to sign. However, R1's payee signed the eviction notice on December 11, 2023, in agreement and was supposed to find another placement for R1. R1 had a history of verbal aggressiveness, not following house rules, and the destruction of property. The local police department met with the facility Administrators due to the increased number of calls within the last six (6) months to the emergency phone line for police officers to come to the facility.

R1 had the payee switched back to themselves from the outside source. R1 has not paid rent to the facility since February 2024. R1 left the facility on March 27, 2024, after they broke a door, grabbed some belongings, left the property, and stated they "would not be back to the facility". On March 31, 2024, staff packed the rest of R1s belongings and placed them in storage on site. The outside source and family members have been informed that they may pick up R1's additional property and as of this report, the property is still at the facility. Documentation from the family and the outside source revealed that they were aware of the behavior of R1 and had not followed through with placement since December 2023.

Allegation 2: The staff did not allow the client to enter the facility. R1 returned to the facility on April 4, 2024, causing a disturbance, and the local police were called. The facility stated that the police department informed R1 that they needed to leave the premises. R1 has not been back to the facility since April 4, 2024. The facility policy stated, "Abandonment of property and removing belonging: In the event the client leaves and removes their property and it has been longer than 3 weeks, bed will not be held." The facility was notified that R1 currently resides in a hotel.

Based on the findings of the investigation, Unlawful eviction, and staff did not allow client to enter the facility are unsubstantiated. An unsubstantiated finding means that although the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred.

An exit interview was conducted with Roger Hernandez, Administrator.  A copy of this report and Licensee's Rights (LIC 9058 03/22) were provided to the Administrator and his signature on this report confirms receipt of the Licensee Rights.
