Licensing Program Analyst (LPA) Renita Hall conducted an unannounced visit to initiate a complaint investigation regarding the above-mentioned allegation and deliver findings. The Administrator allowed LPA entry. LPA identified herself and disclosed the purpose of the visit and elements of the complaint to the Administrator.

Upon receiving the above allegations, an investigation was conducted. The process included interviews with relevant staff members, review of incident reports, and examination of facility policies and procedures regarding clients' personal belongings. During the visit, LPA conducted a tour of the facility, collected resident records, and personnel records.

On April 17, 2025, the Department received a complaint regarding the allegations mentioned above. Interviews with staff and clients revealed consistent adherence to established procedures for safeguarding clients’ belongings.

No evidence or documentation was found indicating loss or mishandling of client property. Admission agreement for personal property log, resident did not complete. The facility policy stated, "The Licensee/Administrator, and employees will not be responsible for any money, valuables, or personal property brought into this facility by guests, relatives, or friends. We will not be responsible for any cash resources, valuables, or personal property brought into this facility unless these items are given to the Licensee or administrator for safeguarding."

All relevant staff and clients were interviewed regarding the claim. There is no evidence, including witness testimony or documentation, to support the allegation that staff encouraged or permitted inappropriate activities for helping with cleaning sewage after rain. The facility has undergone remolding with new roof, windows, doors, and fencing. The Administrator stated that next phase is the remolding of all bathrooms.

Based on the information obtained during the investigation, both allegations are unsubstantiated. There is insufficient evidence to support claims that staff failed to safeguard clients' belongings or encouraged clients to participate in inappropriate activities. A finding that is unsubstantiated means that although the allegation may have happened or is valid, there is not a preponderance of evidence to prove that the alleged violations occurred.

An exit interview was conducted with Roger Hernandez, Administrator. A copy of this report and Licensee's Rights (LIC 9058 03/22) were provided to the Administrator, and his signature on this report confirms receipt of the Licensee Rights
