Licensing Program Analyst (LPA) Arian Golbakhsh conducted an unannounced visit to conduct a complaint investigation and delivered findings regarding the above mentioned allegations. LPA was welcomed by, identified themselves to, and discussed the purpose of their visit to Executive Director (ED) Roger Hernandez. Note, LPA did step out for lunch from 12-1pm.

On 04/29/2024, the Department received a complaint where it was alleged that the facility was in need of renovations and that residents were smoking indoors. The complaint specified that windows and doors were consistenlty broken, plumbing would not work, and that a top stair on a staircase was a tripping hazard. The Department’s investigation consisted of unannounced facility visits, records review, and interviews with staff, residents, and outside sources.

In regards to the allegation of the facility being in disrepair, LPA observations during initial facility visit (5/2/24) noted no defects/hazards on the staircases of building 2 or broken windows. Interviews with residents and staff all revealed that maintenance has been and is done fairly quickly. No concerns for maintenance were revealed during interviews aside from concerns of a carbon monoxide detector in a unit needing a new battery. Interview with administrative staff revealed the facility does not keep records of completed maintenance tasks, aside from text messages with maintenance for updates, which were unable to be retrieved. Interviews with outside sources revealed that repairs to the roof and new paint were completed around the time of the received complaint.

In regards to the second allegation regarding residents being allowed to smoke indoors, interviews with staff and residents corroborated understanding that residents may not smoke indoors. Out of eleven (11) residents interviewed, nine (9) stated that residents cannot smoke inside. The remaining two (2) did not answer. Most residents interviewed stated that there were designated smoking areas outside and that if caught smoking indoors, residents are told to put it out or go outside. One (1) resident stated that if someone gets caught smoking inside multiple times, they'll get an eviction notice, which was corroborated by one (1) staff interview. Interviews with three (3) staff corroborated that residents may smoke in outdoor areas and not inside. One interview with administrative staff revealed that county facilitated presentations on quitting smoking are conducted several times a month. LPA observations during visits on 9/4/25 and 10/28/25 noted residents smoking outdoors.

Based on interviews and records review, while the allegations may have happened or are valid, there is not a preponderance of the evidence to prove that the alleged violations occurred – therefore the allegations have been determined to be UNSUBSTANTIATED. An exit interview was conducted with ED Hernandez to whom a copy of this report and the Licensee/Appeal Rights (LIC 9058) were provided. Their signature below confirms receipt of these documents.
