32 | Director and staff explained that on 02/02/21, C1 sustained minor arm injuries that did not require medical treatment while in care. On 02/02/21, C1 was observed, by a staff member, hitting another child on the play yard. When C1 was redirected, C1 threw a tantrum while sitting on a bench and fell backwards, causing injury to C1’s wrist. On 06/28/21 C1, bumped their arm on the bench in the play yard.
Staff members explained that two teachers are present to supervise children during outdoor activities. LPA reviewed C1’s accident reports and discussed safety plans. A review of accidents report revealed C1’s parent was notified of the incidents that occurred. Children interviewed had no issues with staff and enjoy attending the facility. Although C1 sustained minor injuries while in care, they appear to be accidental, rather than a result of a lack of supervision or a personal rights violation.
It was alleged staff are not adequately supervising day care children, which resulted in multiple biting incidents and an unidentified child wandering unsupervised on the play yard. Director stated C1 had multiple biting incidents. It was reported that C1 had biting incidents on 03/15/21, 03/26/21, 07/12/21, and 08/19/21. According to the facility director, a biting plan was discussed with C1’s parent on 03/26/21. Facility staff interviewed confirmed an increased supervision plan. It was reported that staff have been observed on their cell phones while supervising children. Director denied inadequate supervision due staff using their cell phones. Director stated, staff are permitted to have their phones in the classrooms but are advised not to utilize phones while children are present. Children interviewed denied observing staff on their phone. Based on conflicting information, LPA was unable to determine if staff cell phone use resulted in a lack of supervision.
It was alleged on 09/09/21, a staff member (S1) threatened to withhold an unidentified daycare child’s blanket during nap time if the child did not listen. During interview with LPA, S1 denied allegation and explained during nap time multiple children place their blankets around their heads and throw their blankets while resting on their cots. S1 stated children are informed that if their blankets are not used in the correct manner to then the blanket will be returned in their assigned cubby. Interviews with multiple children revealed that children do not feel threaten by staff members at the facility. Based on limited conflicting information, LPA was unable to determine the child’s identity and whether or not the alleged incident occurred.
