On 2/9/24 at 1:30 PM, Licensing Program Analyst (LPA) Keturah Lane conducted an unannounced complaint visit for the complaint received on 12/29/23, for the purpose of delivering findings on the above referenced allegations. Upon arrival, LPA met with Director Jen Low and toured the facility. Census was 52 children in 5 classrooms with 6 staff members. LPA observed appropriate capacity, ratio and supervision at time of visit which was during naptime and following naptime ratios. All staff present were fingerprint cleared and associated to the facility.

LPA discussed resources with Director and preventing children from biting in the classroom. Director stated they had a staff meeting on 1/25/24 with staff members from rooms 12 & 3 (2 year old classrooms). They have provided teethers/frozen teethers/chew toys with texture for the children (in both classrooms) who show the need for biting/teething. Director stated, "We placed an additional staff member in room 12 starting 1/8/24, but there hasn't been a bite since then. LPA e-mailed additional resources that Director may use to provide training to staff members. (continued on LIC9099-C...)

Based upon information obtained during interviews with complainant, director, staff and parents of enrolled children and from documentation reviewed from complainant and facility, it is determined that the second bite C2 received from C1 could have been prevented. S1 stated that had another staff member been present in the classroom to visually supervise/redirect the children while she was changing a diaper and did not have the other children in her direct vision, the second bite most likely would not have occurred. S1 stated that another staff member was not available to help her. S1 stated that C1 had bitten C2 twenty minutes previously and was still agitated when the second bite occurred. It is also determined based upon interviews with complainant, staff, director and parents of enrolled children that parent of C2 did not receive the incident report for the second bite (only the first bite) at the time of pickup even though both occurred before naptime. Parent was provided the second incident report only after requesting it via e-mail the next day. Director and S1 stated it was an error and S1 forgot to give the parent the second note at pickup.

The allegations are valid because the preponderance of evidence has been met, therefore both allegations are found to be SUBSTANTIATED. Please see LIC9099D for Type B deficiencies cited. Exit interview conducted and report was reviewed with Director Jen Low. A notice of site visit was provided and must be posted for 30 days.

In classrooms where a child that is a known biter is present, staffing should include an extra staff member to help with supervision of the child that bites to prevent it from occurring. Director stated she will provide a training on how to prevent biting in the classroom and to inform staff members to ask for help when needed.

When help is requested in a classroom due to supervision needs and/or biting, Director will send a staff member or herself to help in the classroom immediately. Director stated she will provide the training by 2/23/24 and e-mail the staff signed/dated meeting agenda to LPA Lane by EOB on 2/23/24.

Director shall include a training by 2/23/24 that includes directions to staff members on how to fill out and deliver incident reports for parents. Incident reports shall be delivered and communicated to parents same day of the incident at pickup.

Based upon interviews with Director, staff, complainant and parents, parent of C2 was not notified of the second bite upon pickup from the center. Other parents also stated that notification of injuries and behavior issues (biting) are not consistently communicated or received from the facility which is a potential health, safety and personal rights risk to children in care.

Incident reports should be consistently written for both the biter and child that was bitten and records kept to know which child was bit and when. Director will provide a signed staff agenda dated by 2/23/24 and email to LPA Lane by EOB on 2/23/24.
